Dohrer D. Zinnel R. De Frenza S. Carlson P. Rettberg Absent: M.Colgan J. Meister, Sr. R. Bookler Staff: J. Polony, Plan Review Supervisor, Community Development Zoning Variation—Docket# 13-6 1395 Cumberland Circle West Chairman Childress called the meeting to order at 7:30 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Barry O' Connor, was sworn in and asked to present his case. Mr. O'Connor stated the reason for his variation request is because the current fence has become deteriorated and needs to be replaced. He installed the current fence in 1996 and would like to replace the fence in the same location as the existing fence. Currently his fence extends approximately sixteen(16) feet in front of the adjacent neighbors nearest front corner of the principal building. Mr. Childress opened the meeting to questions from the board. Mr. Carlson asked the petitioner if the fence would be the same height as the current fence and if he had heard any objections from his neighbors. Mr. O' Connor stated the existing fence and proposed fence would be six (6) feet in height. Additionally, he stated he had not heard any objections or concerns from adjacent neighbors about the variation request. Mr. Rettberg asked the petitioner why a six (6) foot high fence was necessary to be installed. Mr. O' Connor stated there is no specific reason for the six (6) foot fence; however any lower of a fence would expose the neighbor's house to be more visible from his rear yard. Mr. Dohrer stated the currently shrubbery and bushes restrict sightlines more than the proposed fence. Additionally, he mentioned the current fence is hidden by the shrubbery. Mr. Rettberg asked the petitioner why a fence was necessary if the current shrubbery concealed his backyard. Mr. O'Connor stated he prefers the fence for privacy and to restrict his dog from running out of the yard. Mr. Childress opened the meeting to questions from the public. Mike Shrader, 1369 Cumberland Circle East, stated he had no objections to the removal and replacement of the current fence. A motion to grant a variation for the construction of a six (6) foot high,privacy fence which would extend approximately sixteen(16) feet beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot was made by Mr. Zinnel and seconded by Ms. De Frenza. Upon voting(AYES—Childress, Rettberg, Dohrer and Carlson.) The motion to grant the variance passed unanimously. Mr. Childress advised the petitioner, Mr. O'Connor, to contact the Village Clerk and attend the subsequent Village Board Meeting.
