Zoning Variation — Docket# 12-6 752 Milbeck Avenue
Chairman Kaplan called the meeting to order at 7:00 pin and read a statement describing the
hearing notification procedure as well as the legal notice. The petitioners, William and Natalie
Halloran, were sworn in and asked to present their case.
Mrs. Halloran stated that a fence variation was requested to offer protection and security in the
backyard for her three (3) year old daughter. She stated that without a variance, her backyard
would be limited in size and they wouldn't be able to utilize more of the yard for recreational
purposes. She felt that the proposed fence location could potentially hinder any vehicles from
going astray into her property.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Meister asked the petitioner if a fence ever existed at the residence.
Mrs. Halloran stated no fence ever existed and the neighbor at 75 Grassmere Road has no
objections to the proposed location of the fence. The neighbor is in favor of the variance so he
can remove his fence and utilize the petitioners proposed fence.
Mr. Zinnel stated that the fence would offer additional protection of the backyard; however the
fence would not stop a vehicle.
Mr. Childress stated that the proposed fence location would have no adverse influence on visual
site line restrictions when the neighbor at 75 Grassmere Road is backing out of the driveway.
Mr. Kaplan then asked if there was anyone from the public who would like to speak. No one in
attendance had any objections or statements.
A motion to grant a variation for the installation of a six foot(6') high cedar fence extending
approximately twelve feet (12') beyond the nearest front corner of the principal structure on the
adjacent single family residential lot was made by Mr. Meister and seconded by Mr. Childress.
Upon voting (AYES—Kaplan, Bookler, Dohrer, Colgan, Carlson, and Zinnel) the motion to
grant the variance passed unanimously. Mr. Kaplan advised the petitioner, Mrs. Halloran,to
contact the Village Clerk and attend the subsequent Village Board Meeting. The meeting
adjourned at 7:12 p.m.
