Chairman Kaplan called the meeting to order at 7:00 pm and read a statement describing the
hearing notification procedure as well as the legal notice. The petitioner, Rajendra Patel, was
sworn in.
Mr. Kaplan read a letter from Ms. Yutaka Hill, 277 Shelley Road, stating her concerns about the
gate of the petitioner's fence encroaching onto her property during the opening of the gate. Ms.
Yutaka also noted in the letter that she was not in favor of the variance request to allow the fence
to extend twelve feet (12') beyond the nearest front corner of her residence.
The petitioner, Rajendra Patel, was asked to present his case.
Mr. Rajendra Patel stated that lie requested the variance to allow for better protection of his son's
window. Rajendra stated that his son's window has been kicked in and vandalized in the past and
a six foot (6')wood fence will provide better security than the previous fou foot (4') chain link
fence. He noted that the wood fence will be located in the same location as the existing chain
link fence.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Zinnel asked the petitioner how long he has lived at this residence.
Rajendra stated he has lived there for eight(8) years.
Mr. Bookler asked the petitioner when the chain link fence was removed.
Rajendra stated the chain link fence was removed approximately two (2) months ago.
Mr. Meister asked the petitioner to state his hardship for the variance request.
Rajendra stated the extended fence would provide more security and protection of his backyard
and son's window. He also mentioned that the six foot (6') wood fence will help to discourage
individuals from jumping the fence and vandalizing his properly.
Mr. Dohrer stated that the gate of the fence would be required to be relocated as to not encroach
onto the neighbor's property during the opening of the gate.
Rajendra agreed that the gate would be relocated or the gate would swing towards his house.
Mr. Kaplan opened the meeting to questions from the public.
Bob Rood, 141 Hastings Avenue, stated that the six foot(6) high wood fence looks out of place
within the neighborhood.
Mr. Kaplan explained that six foot (6) high fences are permitted by the Village Zoning Code.
Dave Schuman, 233 Shelley Road, requested that the gate swing towards the petitioner's house
and not towards the neighbor's property at 277 Shelley Road.
A motion to grant a variation for the installation of it six foot(6') ]sigh fence extending
approximately twelve feet(12') beyond the nearest front corner of the principal structure on the
adjacent single family residential lot was made by Mr. Dohrer and seconded by Mr. Meister. Mr.
Dolrrer requested that the approval be granted with the following conditions: the fence is located
completely on the petitioner's properly and the gate will be relocated to not encroach over the
neighbor's property line. Upon voting (AYES —Kaplan, Bookler, Childress, Carlson, Colgan,
and Zinnel) the motion to grant the variance passed unanimously. Mr. Kaplan advised the
petitioner, Mr. Patel, to contact the Village Clerk and attend the subsequent Village Board
Meeting. The meeting adjourned at 7:24 p.m.
