Kaplan, Chairman D. Childress J. Franke T. Rodgers R. Penley Staff.- V. Zaric, Plan Reviewer, Community Development Zoning Variation — Docket #04-8 — 1899 Liberty Ct. Chairman Kaplan called the meeting to order at 7:00 P.M. and read the legal notice. The petitioner, Rebecca Glick was sworn in and asked to present the case. Mrs. Glick said that their fence was blown down by the storm. They requested to replace the fence with a new one at the same location. Since the Zoning Ordinance changed from the time the fence was built, it could not be approved at the proposed location. The petitioner explained that if the new fence were put at the required location it would be beyond the side house wall. The kitchen bay window would be divided by the fence. The petitioner provided a letter from the neighbor at 1895 Gibson Drive. Chairman Kaplan read the letter, from the neighbor stating that they did not object to the requested variation for the fence location. Mr. Childress said that he inspected the site the night before. He agreed with the petitioner's statement that the bay window would be.half on_ one side and half on the other side of the fence if the fence were installed per the Zoning Ordinance. Mr. Rogers asked what type of a fence they were planning to install. Mrs. Glick said that they are planning to install 5-foot picket fence. • Mr. Franke asked if the letter that the petitioner brought was from the • neighbor behind their house. The petitioner said it was from the neighbor behind their house. Mr. Kaplan asked if anybody from the audience had questions. The neighbor, who lives on Liberty Court cul-de-sac, asked if the petitioner wanted to build the fence closer to the sidewalk than the existing fence. The petitioner stated that the new fence would not be closer to the sidewalk than the existing one. Mr. Franke explained that the new fence would provide better visibility to the motorists since it would be lower that the existing 6-foot fence. A motion was made by Mr. Franke to grant the variation and seconded by Mr. Penley. The motion was passed unanimously. The petitioner was directed by Mr. Kaplan to contact the Village Clerk to confirm which Village Board meeting they should attend for final approval. The meeting was adjourned at 7:10 P.M.
