Zoning Variation — Docket# 04-6— 570 Rutgers Lane
Chairman Kaplan called the meeting to order at 7.30 P.M. and read the legal
• notice. The petitioners, Mr. & Ms. Sullivan were asked to present their case.
Mr. Sullivan explained that they were seeking a variation that would allow the
construction of a garage addition to the side of the existing garage. He pointed
out that only a small, triangular shaped section would encroach into the required
25 ft. setback. The additional space was necessary due to the fact that there
were three adult drivers in the family. Mr. Sullivan also stated that the rear
section of the addition would be an extension of the existing pantry that may
someday be converted into a bedroom. He concluded by saying that he
contacted fifteen neighbors, and that none of them objected to his proposal.
Mr. Franke and Mr. Oliveto asked questions pertaining to design and whether or
not the proposed addition would be similar to another addition in the
neighborhood. Mr. Sullivan said it would be almost identical.
Mr. Walz asked Mr. Sullivan what his planned to do for the driveway. Mr.
Sullivan stated that he would not enlarge the apron, and would taper the
driveway from the sidewalk to the new garage.
Mr. Penley stated that he wanted it to be made clear that there would be a wall
extending across the new garage to create an extension of the pantry, and that
he would not be in favor of a twenty-eight foot (28) deep garage. Further
discussion ensued and it was pointed out that the floor plan submitted to the
• Village did not coincide with what the petitioner was describing. Mr. Sullivan

• stated that he intended the front of the new garage to be even with the front of
the existing garage. Several members of the ZBA pointed out that that is not
what was submitted and that an additional variation would be necessary to permit
encroachment of the front setback. Mr. Sullivan stated that he did not have a
problem with the front of the new garage being setback further than the front of
the existing garage.
Mr. Penley made a motion to grant the variation subject to the condition that an
interior wall be constructed between six (6) and eight (8) feet from the back wall
of the addition which was seconded by Mr. Walz. The motion passed by
unanimous vote.
Mr. Kaplan advised the petitioner to contact the Village Clerk to find out when the
case would be considered by the Village Board. The meeting adjourned at 8:02
P.M.
