Zoning Variation — Docket #04-4 — 231 Tower Ln.
• Chairman Kaplan called the meeting to order at 7:00 P.M. and read the
legal notice. The petitioners, Michael and Carrie Kirkpatrick, were sworn in
and asked to present their case.
Mr. Kirkpatrick explained that their existing fence came down on the
windstorm. They wanted to replace the fence with the new one at the
same location. Since the Zoning Ordinance changed from the time the
fence was built, the fence at the proposed location could not be.approved.
Mr. Childress asked if the petitioner asked the neighbors for the opinion.
The petitioner answered that he asked his neighbor, with whom he shares
the fence, and the neighbor did not have any objections.
Mr. Walz mentioned that he visited the site and talked to the neighbors.
He concurred that the next-door neighbor, Mr. Nelson, did not have any
objections.
Mr. Rogers stated that he measured the part of the fence that extends
beyond the line extended from the nearest front corner of the neighbor's
house to the petitioner's garage front wall, and it was approximately 14
feet.

• Mr. Kaplan noted that the variation request should be changed to a fence
replacement that extends beyond a line extended from the nearest front
corner of the neighbors house to the petitioner's garage front wall.
A motion was made by Mr. Richard to grant the variation as Mr. Kaplan
noted. The motion was seconded by Mr. Walz and passed by unanimous
vote.
The petitioner was directed by Mr. Kaplan to contact the Village Clerk to
confirm which Village Board meeting they should attend for final approval.
The meeting was adjourned at 7:10 P.M.
