Zaric, Plan Reviewer, Community Development • Zoning Variation — Docket #04-11 — 498 Franklin Lane Chairman Kaplan called the meeting to order at 8:20 P.M. and read the legal notice. The petitioner, Phillip Graff was sworn in and asked to present his case. Mr. Graff explained that he is seeking the variation for the roof overhang encroachment into the required side yard. He built the roof and tried to keep the overhang length 12 inches wide as it was specified on the architectural drawings, but he could not match it with the existing roof overhang. Mr. Kaplan asked if he knew that the roof structure was not complying with the approved drawings at the time he was building it. The petitioner said that he was aware of the 12 inches limitation for the roof overhang, and that he tried to build it that way but it was not possible. Mr. Kaplan asked Mrs. Zaric how much the roof overhang exceeded the maximum allowed. • Mrs, Zaric stated that it is extending 8 inches beyond the maximum allowed. Mr. Shumm asked if the oversized garage door was shown on the original drawings. The petitioner said it was not shown on the approved drawings. He decided to install an oversized door after he learned of the Village requirements about parking the recreational vehicles. He is planning to buy a boat which is why an oversized garage door was installed. Mr. Shumm also asked if the petitioner had any professional help while building the roof. Mr. Graff said that he hire an architect to do the drawings and had advice from professionals such as carpenters and decorators. Mr. Shumm also inquired about the proposed 30 foot wide driveway. He stated that at the previous public hearing the petitioner was asked about the driveway who stated that he would like to build 20 feet wide driveway by the apron and widen it under 45 degree angle toward the garage until • 30 feet width is reached. The petitioner stated that the 30 foot wide driveway is needed for the boat, which he is planning to buy. Mr. Rodgers said that he does not like the oversized garage door in the residential area. He asked if the neighbors had any objections about the door. The petitioner said that the neighbors liked the door. Mr. Franke asked Mrs. Zaric if there are restrictions in the Building Code about the garage door size. Mrs. Zaric said that there were no restrictions. Mr. Childress noted that the new roof overhang width matches the existing roof overhang on the other side of the house. Mr. Walz said that he does not like the fact that the petitioner changed his • mind on the items he was questioned about at the previous public hearing. A motion was made by Mr. Franke to grant the variation and seconded by Mr. Oliveto. The Board members were called to vote. Mr. Shumm - No Mr. Walz - No Mr. Franke - Yes Mr. Rodgers - Yes Mr. Penley - No Mr. Childress - Yes Mr. Oliveto - Yes The motion was passed by a vote of 4 to 3. The petitioner was directed by Mr. Kaplan to attend the next Village Board • meeting for the final approval.
