AN ORDINANCE AMENDING SECTION 3-25-1 DEFINITIONS AND SECTION 3-25-4 OF
CHAPTER 25 OF TITLE 3 OF THE ELK GROVE VILLAGE CODE RELATING TO THE
LOCATION OF SMALL WIRELESS FACILITIES IN THE VILLAGE
WHEREAS, Chapter 25 Small Wireless Facilities of Title 3 of the Elk Grove Village Code
currently permits said facilities to be located solely in Village Right -of -Ways; and
WHEREAS, Village staff has recommended that said facilities also be permitted on Publicly -
Owned Property as approved by staff; and
WHEREAS, the Mayor and Board of Trustees, after having reviewed the recommendations of
staff, find and believe it to be in the best interests of the Village to amend Chapter 25 accordingly.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 3-25-1 DEFINITIONS of the Village Code be amended by adding
thereto the following:
PUBLICLY — OWNED PROPERTY: Means property that is owned by a government entity, such
as a park district, library district, school district or a municipality.
Section 2: That Section 3-25-4 RESIDENTIAL ZONING DISTRICTS - STANDARDS AND
REGULATIONS be amended to read as follows:
Small Wireless Facilities in residential zoning districts, including but not limited to R-1, R-2, R-3,
R-4, A-1, A-2, and A-3 districts, shall require a special use permit as provided for in the Village's
Antenna Siting Policy, except when collocated in the Right -of -Way of a residential zoning district or
located on Publicly -Owned Property. Small Wireless Facilities located on Publicly -Owned Property shall
be required to meet the standards and regulations listed in Section 3-25-6.
Section 3: That this Ordinance shall be in full force and effect from and after its passage,
approval and according to law.
