Zoning Variation —Docket #15-5 401 Charles Drive
Acting Chainnan Dohrer,called the meeting to order at 7:48 pm and read a statement describing
the hearing notification procedure as well as the legal notice.
The petitioner, Krzysztof Szponar, was sworn in and asked to present his case.
Mr. Szponar stated the reason for his variation request was because he is remodeling the existing
house and would like the front elevation of the house to blend with the renovated construction.
The existing front deck will be covered with a roof overhang to help tie into the new look of the
home.
Mr. Dohrer opened the meeting to questions from the board.
Mr. Carlson asked the petitioner when construction of the remolded house would be complete.
Mr. Szponar stated the house should be complete within ten(1) months.
Mr. Dohrer asked the petitioner if the whole house would be remodeled.
Mr. Szponar stated the existing house would be completely remodeled and additions would be
constructed to the existing house.
Mr. Dohrer opened the meeting to questions from the public.
Ted Karamatskos, 416 Charles Drive, slated his concerns about the location of the proposed
porch overhang and how it would impact his ability to see Busse Woods from his home.
Mr. Szponar stated the new roof porch should have no more of an impact than what currently
exists at the site. All the other work associated with his renovation project will not impact Mr.
Karamatskos ability to view Busse Woods.
Howard Paul, 285 Cosman Road, expressed his support for the proposed variation request. I-Ie
indicated the petitioner's home has been vacant and undeveloped for many years. He felt that the
new renovation work and variation would be a great thing for the Village and would help to
enhance property values around the neighborhood.
A motion to grant a variation to alter a non conforming structure and construct of an eleven foot
six inch (11 '-6") roof over the front deck that will encroach into the required front yard setback
was made by Mrs. DeFrcnza and seconded by Mr. Carlson. Upon voting (AYES—Colgan,
Bookler and Dohrer.) The motion to grant the variance passed unanimously. Mr. Dohrer
advised the petitioner, Mr. Szponar, to contact the Village Clerk and attend the subsequent
Village Board Meeting. The meeting adjourned at 8:00 p.m.

On May 7th, 2015, the Zoning Board of Appeals' Acting Chairman Dohrer called the hearing to order at
approximately 7:45 pm, and read the legal notice of the meeting.
Petitioner Krzysztof Szponar, was sworn in and asked to present his case, summarized as follows:
The variance request is in regard to the Elk Grove Village Zoning Ordinance No. 2410, as it pertains to
modifications of a non-conforming structure. Section 3-7: D (1), and the Schedule of Bulk and Yard
Requirements, in Table 7-1, prohibit a principal structure from being located in any required front yard
area.
The Petitioner is seeking a variation to allow the construction of a roof over an exterior deck that will
encroach into the required twenty five feet (25') front yard setback.The proposed roof structure will
extend approximately eleven and a half(11'-6) feet from the back of the house. The house currently
encroaches into the twenty five feet (25') front yard setback by approximately one foot ten inches (1'-
10").
Additionally, the Petitioner is requesting a variation from Section 3-6: A(2)(a) which prohibits a
nonconforming use from being extended to occupy any portion of the premises which was not originally
occupied by the nonconforming use. The current building is located approximately twenty three feet
and two inches(23'-2") from the front setback line which constitutes the building as a nonconforming
structure. The petitioner is seeking a variation to allow a thirteen feet -four inch (13'4")
encroachment into the front yard of the nonconforming structure.
The variation request is for the property located at 401 Charles Lane, Elk Grove Village, and is identified
by the following property identification number: 08-29-400-064-0000.
