Kozor, Plan Reviewer/Inspection Supervisor, Community Development Zoning Variation — Docket #18-7 1101 Cypress Lane Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Daniel Candir, was sworn in and asked to present his case. Mr. Candir explained that his five (5') foot solid fence was in disrepair, and in the process of applying for a permit, was informed that his current fence was not in an approved location. Mr. Candir decided to change from a privacy fence to an open four (4') foot chain link fence to not impair sight lines. Mr. Childress opened the meeting to questions from the board. Mr. Bacigalupo asked what Mr. Candir's hardship was. Mr. Candir explained the size of his backyard would be substantially decreased, and existing mature landscaping would make it difficult to relocate the fence to the approved location. Ms. Kelley asked what the height of the existing chain link fence is. Mr. Candir responded that it was also a four (4') foot open chain link fence. Mr. Dohrer asked how much of the five (5') foot privacy fence would be replaced. Mr. Candir responded that the entire rear five (5') foot privacy fence would be replaced with the four foot (4') chain link fence. Mr. Dohrer and Mr. Childress agreed that they did not see that the replacement of the fence would cause any sight line issues. Building and Engineering was asked if they had any issues, and Mr. Kozor responded that they did not have any issues. Mr. Bacigalupo added that the petitioner did not have a valid hardship. A motion to DO GRANT a variation for the installation and construction of a four (4') foot high fence which will extend approximately forty-nine (49') feet beyond the nearest front corner of the principal structure on the adjacent single-family residential lot was made by Mr. Dohrer and seconded by Ms. Kelley. Upon voting (AYES — Kelley, Childress, Dohrer, Colgan.) (NAYES- Bacigalupo.) The motion to DO GRANT the variance passed by a vote of 4 to 1. Mr. Childress advised the petitioner to contact the Village Clerk and attend the subsequent Village Board Meeting.
