Zoning Variation — Docket #18- 3 1450 James Way
Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the
hearing notification procedure as well as the legal notice.
The petitioners, Thaddeus and Lauren Stefan, were sworn in and asked to present their case.
Mr. Stefan indicated that they would like to install a six (6') foot privacy fence which extended
further than the existing fence toward James Court. The fence would enlarge the backyard area
and provide for additional privacy.
Mr. Childress opened the meeting to questions from the board.
Mr. Colgan asked the petitioners if the existing shrubs along the fence line were on their property
because the shrubs extended just as far as the proposed fence.
Mr. Stefan indicated that the shrubs were on their property.
Mr. Dohrer suggested that the fence along James Court be angled or run parallel with the
sidewalk to limit the proximity to the adjacent sidewalk. The proposed fence along the property
line abutting James Court must be setback at least three (3') feet and run parallel to the sidewalk.
(See attached sketch for modification)
The petitioners agreed to hold the fence back on an angle that would run parallel with the
sidewalk.
Mr. Childress mentioned that since the petitioners have agreed to hold the fence back along the
sidewalk, the second variation request for the proximity to the street side property line would not
be needed.
Mr. Polony confirmed that no variation for the proximity to the street side property line would be
needed as long as the petitioners held the fence back at least three (3') from the sidewalk. This
would be accomplished by the agreed upon modification to the variation request which will
require a section of fence to run parallel with the sidewalk per the attached sketch.
Mr. Childress opened the meeting to questions from the public.
Debbie Futschek, 1446 James Court, mentioned that she had no objection to the proposal and
indicated that the property owners have put a lot of effort into making the home aesthetically
appealing.
Bob Leski, 1490 Hodlmair Lane, had no objections to the request.
A motion to DO GRANT a variation for the installation and construction of a six (6') foot high
wood fence which will extend approximately forty six (46') feet beyond the nearest front corner
of the principal structure on the adjacent single-family residential lot with one section running
parallel with the sidewalk (per the attached sketch), was made by Mr. Dohrer and seconded by
Mrs. Larson. Upon voting (AYES —Kelley, Larson, Childress, Dohrer, Colgan,, DeFrenza.)
The motion to DO GRANT the variance passed unanimously.
Mr. Childress advised the petitioners to contact the Village Clerk and attend the subsequent
Village Board Meeting. The meeting adjourned at 7:15 p.m.
Respectfully submitted,
Jared
