ORDINANCE DECLARING THE NECESSITY AND CONVENIENCE OF THE
CONVEYANCE OF CERTAIN PROPERTY LOCATED AT 600 LANDMEIER ROAD
IN ELK GROVE VILLAGE FROM THE ELK GROVE PARK DISTRICT TO THE
VILLAGE OF ELK GROVE (VILLAGE PUBLIC WORKS FACILITY)
WHEREAS, the Village of Elk Grove Village and the Elk Grove Park District are
municipalities as defined in the Local Government Property Transfer Act (50 ILCS 605/1 et seq.)
("Act") the territory of the Village being located partly within and partly without the corporate
limits of the Elk Grove Park District; and
WHEREAS, the Village of Elk Grove Village ("Village") is a home rule municipality;
and
WHEREAS, the Elk Grove Park District ("Park District") is the owner of a parcel of
land for which the Park District has no further use, and which is legally described in Section 3 of
this Ordinance; and
WHEREAS, the Village as the transferee municipality as set forth in the Act, hereby
declares that it is necessary and convenient for the Village to use, occupy, or improve the real
estate held by the Park District, as the transferor municipality as set forth in the Act, and as
legally described in Section 3 of this Ordinance, for a public purpose; and
WHEREAS, it is necessary and convenient for the Village of Elk Grove Village to
acquire and accept from the Elk Grove Park District the legal title to the real estate legally
described in Section 3 of this Ordinance in order to supplement, correct, and complete the
acquisition of the underlying parcels of real estate already included in the EG Township Plat Of
Subdivision dated May 4, 2018, and recorded with the Cook County Recorder of Deeds on May
7, 2018, as Document Number 1812716072, and also to supplement, correct, and complete the
subsequent conveyance of Lot 1 in the EG Township Subdivision from the Village of Elk Grove
Village to Elk Grove Township as set forth in the Special Warranty Deed dated June 7, 2018,
and recorded with the Cook County Recorder of Deeds on June 11, 2018, as Document Number
1816246123.
NOW, THEREFORE, be it ordained by the Mayor and Board of Trustees of the Village
of Elk Grove Village, Cook and DuPage Counties, State of Illinois, as follows:
Section 1: That the Village as the transferee municipality as set forth in the Local
Government Property Transfer Act, hereby declares that it is necessary and convenient for the
Village to use, occupy, or improve the real estate held by the Elk Grove Park District, as the
transferor municipality as set forth in the Act, and as legally described in Section 3 of this
Ordinance, for a public purpose.
Section 2: That it is necessary and convenient for the Village of Elk Grove Village to
acquire and accept from the Elk Grove Park District the legal title to the real estate legally
described in Section 3 of this Ordinance in order to supplement, correct, and complete the
acquisition of the underlying parcels of real estate already included in the EG Township Plat Of
Subdivision dated May 4, 2018, and recorded with the Cook County Recorder of Deeds on May
7, 2018, as Document Number 1812716072, and also to supplement, correct, and complete the
subsequent conveyance of Lot 1 in the EG Township Subdivision from the Village of Elk Grove
Village to Elk Grove Township as set forth in the Special Warranty Deed dated June 7, 2018,
and recorded with the Cook County Recorder of Deeds on June 11, 2018, as Document Number
1816246123.
Section 3: That the Village of Elk Grove Village will accept the conveyance of the
following legally described parcel from the Elk Grove Park District, subject to conditions and
covenants of record, private and public easements, drainage ditches, tiles and lateral feeders, if
any, and general real estate taxes for 2018 and hereafter:

Section 4: That the Quit Claim Deed from the Elk Grove Park District to the Village of
Elk Grove Village conveying the Park District's interest in the property described in Section 3 of
this Ordinance shall be recorded with the Cook County Recorder of Deeds as soon after passage
of this Ordinance as reasonably possible.
Section 5: That the Village may accept a conveyance of the property described in
Section 3 of this Ordinance on the above and foregoing terms, provided that the Park District has
adopted the necessary authorizing Resolution as contemplated by the Act.
Section 6: That the Mayor and Village Clerk, along with the Village Manager, be and
are hereby authorized and directed to take such steps and execute such documents as shall be
necessary or advisable to accomplish the intent of this Ordinance.
Section 7: That this Ordinance shall be in full force and effect from and after its date of
passage and approval according to law.
