HomeMy WebLinkAboutRESOLUTION - 12-19 - 2/12/2019 - Class 6B - 820 Nicholas Blvd.RESOLUTION NO. 12-19 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 611 STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED JULY 27, 2018 FOR CERTAIN REAL ESTATE LOCATED AT 820 NICHOLAS BOULEVARD, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of July 27, 2018, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, in the case of abandoned property, if the municipality or the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of Class 613, even though it has been vacant and unused for less than 24 months, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application. Such resolution or ordinance shall be filed with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the Board of Commissioners of Cook County is required to validate such shortened period of qualifying abandonment, and a resolution to that effect shall be included with the Class 6B eligibility application filed with the Assessor; and WHEREAS, the Petitioner has applied for or is applying for Class 6B property status pursuant to said aforementioned ordinance for certain real estate located at 820 Nicholas Boulevard, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Number 08-26-301-033-0000, and has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the request of the Petitioner to have certain real estate located at 820 Nicholas Boulevard, Elk Grove Village, Cook County, Illinois, identified by Property Index Number 08-26-301-033-0000, declared eligible for Class 6B special circumstances status pursuant to the Cook County Real Property Classification Ordinance as amended in July 27, 2018, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 6B Tax Incentive Ordinance is necessary for the said development to occur on the subject property, legally described as follows: LOT 3 IN CENTEX INDUSTRIAL PARK NORTH UNIT 2, A SUBDIVISION IN SECTION 26, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 6B Application and approves the classification of the subject property as Class 6B property pursuant to the Cook County Real Property Classification Ordinance and the Class 6B tax incentives shall apply to the property identified as Permanent Real Estate Index Number 08- 26-301-033-0000. Elk Grove Village is in receipt of an economic disclosure statement that is included with the application packet. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution subject to the petitioner completing the following conditions within twelve months of closing: a. Update the fagade per the attached Exhibit "B" as submitted by applicant; b. Update landscaping and signage; c. Reconstruct the parking lot, update the driveway apron and dock drive. Section 5: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES:4 NAYS:0 ABSENT:2 PASSED this 1211 day of February 2019. Johnson Village of Elk Grove Village 2 EXHIBIT A SARNOFF * BACCASH Rembrandt Hardware Group LLC, or an entity to be named ("Applicant"), is requesting a Resolution in support and consent of a Class 6b Incentive on the above -referenced property based on occupation of an abandoned property that has been vacant for less than 24 continuous months with a purchase for value, special circumstances and substantial rehabilitation. The Applicant plaits to purchase the subject property and rehabilitate the same to occupy for its operations consisting of the assembly, warehousing and distribution of glass and glass related products for various industries. In addition, the Applicant's new related entity, Rembrandt Tempering, will be occupying the subject property for its operations consisting of the tempering of glass and Mass related products for various industries. Additionally, the Applicant plans to lease a small portion of the office space to Black Wolf Transportation Inc, for its transportation company. The subject property consists of an approximately 24,050 square foot site with a roughly 10,000 square foot building that has been 100% vacant and unused since January 2, 2018. The property is in need of.substantial rehabilitation. Therefore, the Applicant plans to invest approximately $85,000 to immediately rehabilitate the subject property. Based on initial inspections these itnprovernents will be to improve the fagade, install a new drive in door, improve the landscaping, improve the parking lot and dock (including upgrading the drive in aprons per Elk Grove Village standards), add new signage and upgrade the electrical as well as to complete other general maintenance. Please note that all of the rehabilitation costs could significantly vary depending can a variety of factors such as market variances. Further inspections of the subject property may require additional improvements. The rehabilitation will create approximately 20 to 25 construction jobs. Rembrandt Hardware Group LLC." currently leases two sites for its operation, approximately 3,000 square feet located at 724 Foster .Ave. in Bensenville and approximately 10,000 square feet located at 2525 Higgins Rd. in Elgin. Rembrandt Hardware Group LLC has 2 employees (all full-time), and although it will maintain its Elgin location for storage, it will move its operation and employees from the Bensenville location to the subject property. It is because of the new related business, Rembrandt Tempering, that the Applicant needs additional space, The Applicant believes that Rembrandt Tempering will create 2 to 4 employees (all full-time) as soon as possible. Additionally, Black Wolf'rransportation Inc., has 4 employees (3 full-time and I part-time) and will move its entire operation from the Bensenville location noted above, where it is currently located, to the subject property and may hire an additional employee in the: next few years. In addition, all three occupants will look to hire all qualified Elk Grove Village residents for future hires. Elk Grove Village can also expect that all three occupants and its employees will invest commercially back into the community by visiting local establishments such as restaurants, gas stations, grocery stores and more. In addition, Elk Grove Village can expect that all three occupants will attract business and various customers to the Village in the course of their operations. Based on our research and the additional costs that must be incurred to rehabilitate the building in order for [his to be a successful endeavor, the Applicant must possess a Class Cab Incentive. to complete: the improvements and to successfully operate the property. it is for these reasons that it is necessary to grant the Applicant a Resolution in support and consent of Class 6b Incentive for the subject property based on occupation of an abandoned property that has been vacant for less than 24 continuous months with a purchase for value, special circumstances and substantial rehabilitation, Exhibit "B" z, Elk Grove Village Class 613 Property Tax Terms and Agreement The APPLICANT shall perform the WORK upon the SUBJECT PROPERTY located at 820 Nicholas Rd. in accordance with the PLANS and in full compliance with all applicable codes, ordinances, rules, regulations, permits, and plans as outlined in Attachment A, imposed by the VILLAGE, and shall complete the WORK in a good and workmanlike manner or risk voiding this agreement. The WORK shall include all building and landscaping alterations as proposed by the APPLICANT in exchange for the VILLAGE'S approval of a Cook County Class 6B Property Tax Abatement. The APPLICANT, will be issued a Letter of Receipt upon submission of a completed Elk Grove Village Class 68 Application Packet. This letter may be used to inform the Cook County Assessor's Office that the Village of Elk Grove is in receipt of the Applicant's request for a Cook County Class 613 Property Tax Abatement. The Letter of Receipt is not a guarantee of final approval and the Applicant may move ahead with their project at their own risk. The Letter of Receipt will serve as official notice that the APPLICANT is eligible for the incentive; however, final approval is not complete until there is an official Resolution passed by the Village. The Resolution will not be executed until such time all proposed work is complete. The APPLICANT has 365 days from taking ownership or tenancy to complete all proposed alternations and submit a full accounting of costs. If costs are not consistent with promises made in the original application, the APPLICANT may not be granted a final resolution of 613 approval. This AGREEMENT sets forth all the promises, inducements, agreements, conditions and undertaking between the APPLICANT and the VILLAGE relative to the subject matter thereof, and there are no promises, agreements, conditions or understandings, either oral or written, expressed or implied, between them, other than as set forth herein. No subsequent alteration, amendment, change or addition to this AGREEMENT shall be binding upon the PARTIES hereto unless authorized in accordance with the law and reduced in writing and signed by them.
