AN ORDINANCE ANNEXING AND CURING ANY AND ALL DEFECTS RELATED
TO THE ANNEXATION OF CERTAIN PROPERTY TO THE VILLAGE OF ELK
GROVE VILLAGEAND TO ZONE SAID PROPERTY IN ACCORDANCE WITH THE
VILLAGE'S ZONING ORDINANCE (METROPOLITAN WATER RECLAMATION
DISTRICT OF GREATER CHICAGO PROPERTY)
WHEREAS, a valid petition, signed on behalf of the Metropolitan Water Reclamation
District of Greater Chicago (the "MWRD") as legal owner of record of all land within the territory
herein described (the "Subject Property"), was filed with the Village of Elk Grove Village, Illinois
(the "Village"), requesting annexation of the Subject Property to the Village pursuant to a mutually
satisfactory annexation agreement; and
WHEREAS, on June 28, 2018, the Village adopted Ordinance No. 3559, entitled An
Ordinance Approving an Intergovernmental Annexation Agreement Between the Metropolitan
Water Reclamation District of Greater Chicago and the Village of Elk Grove Village, which
ordinance duly authorized a valid and binding pre -annexation agreement ("Annexation
Agreement") between the Village and the MWRD; and
WHEREAS, on June 28, 2018, the Village also adopted Ordinance No. 3560, entitled An
Ordinance Annexing and Rezoning Certain Territory to the Village of Elk Grove Village
(Metropolitan Water Reclamation District of Greater Chicago), in an effort to annex the Subject
Property in accordance with the provisions of the Annexation Agreement; and
WHEREAS, subsequent to the passage of Ordinance No. 3560, the Village discovered
that proper notice of the annexation was not perfected as required by the Illinois Municipal Code,

65 ILCS 5/7-1-1 et seq, and, more specifically, written notice was not served upon the trustees of
the Elk Grove Rural Fire Protection District and an affidavit of such service was not filed with the
Cook County Recorder; and
WHEREAS, the Village's failure to provide proper notice as set forth in Section 7-1-1 of
the Illinois Municipal Code (65 ILCS 5/7-1-1) rendered the attempted annexation of the Subject
Property ineffective; and
WHEREAS, preceding the passage of this Ordinance, the Village passed and approved
Ordinance No. 3583, declaring that the attempted annexation of the Subject Property pursuant to
Ordinance No. 3560 was ineffective; and
WHEREAS, the Annexation Agreement related to the Subject Property requires that both
the Village and the MWRD do all things necessary or appropriate to cause the Subject Property to
be duly and validly annexed to the Village and further requires that the Village and the MWRD do
all things legally necessary and appropriate to cure any and all defects with respect the annexation
of the Subject Property; and
WHEREAS, in accordance with the terms of the Annexation Agreement, the Village now
wishes to do all things necessary to duly and validly annex the Subject Property and has taken all
necessary efforts to cure the defects related to the annexation of the Subject Property;
WHEREAS, on December 28, 2018, the Village served written notice of the proposed
annexation upon any Fire Protection District trustee, Library District trustee, Township official or
other entity or person entitled to notice prior to the annexation of the Subject Property as is required
by law; and

WHEREAS, the affidavits of service of such notices required herein are on deposit with
the Village Clerk and have been recorded in the office of the Recorder of Cook County, as is
required by law; and
WHEREAS, there are no electors residing within the Subject Property; and
WHEREAS, the Subject Property is not within the corporate limits of any municipality
but is contiguous to the Village of Elk Grove Village; and
WHEREAS, all petitions, documents and other necessary legal requirements are in full
compliance with the terms of the Annexation Agreement and with Article 7, Division 1 of the
Illinois Municipal Code (65 ILCS 5/7-1-1, et seq.), specifically Section 7-1-8 of said Article (65
ILCS 5/7-1-8); and
WHEREAS, the Village, as a home rule municipality, possesses broad authority to
"exercise any power and perform any function pertaining to its government and affairs" in
accordance with Article VII, § 6 of the Illinois Constitution of 1970; and
WHEREAS, the Mayor and Board of Trustees find it to be in the best interest of the Village
that said land and territory be annexed to the Village pursuant to the provisions of the Annexation
Agreement and Article 7, Division 1 of the Illinois Municipal Code (65 ILCS 5/7-1-1, et seq.),
specifically Section 7-1-8 of said Article (65 ILCS 5/7-1-8), and be zoned upon annexation
pursuant to the Village Zoning Ordinances.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: The facts and statements contained in the preambles to this Ordinance are found
to be true and correct and are hereby adopted as part of this Ordinance.

Section 2: That Subject Property, legally described in Exhibit "A" attached hereto and
made a part hereof and depicted in the Plats of Annexation attached hereto and made a part hereof
as Exhibit "B", which is contiguous to the Village of Elk Grove Village and is not within the limits
of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village,
so that said territory shall be included within the boundary limits of said Village as is by law in
such case made and provided.
Section 3: That upon annexation, the Subject Property shall be zoned to the I-1 Industrial
District in the Village of Elk Grove Village, in accordance with Chapter 6, Section 64A, of the
Zoning Code of the Village of Elk Grove Village.
Section 4: That the Mayor is hereby authorized to execute and the Village Clerk is hereby
authorized to attest to the Plats of Annexation of Subject Property.
Section 5: That the Village Clerk of the Village of Elk Grove Village is directed to record
a certified copy of this Ordinance together with the Plats of Annexation of the Subject Property,
as appended hereto, with the Recorder of Deeds of Cook County Illinois.
Section 6: That the Village Clerk is hereby directed to file with the County Clerk and the
Cook County Election Department a certified copy of this Ordinance together with the Plats of
Annexation of the Subject Property, as appended hereto, and to report the annexation of the Subject
Property to the proper postal service officials.
Section 7: That the Village Clerk is directed to amend the official Village map in
accordance with the provisions of this Ordinance.
Section 8: That the Village Clerk is authorized to publish this Ordinance in pamphlet form.

Section 9: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.
