AN ORDINANCE AMENDING SECTION 4-2-2: SPECIFIC NUISANCES
ENUMERATED AND SECTION 4-4-6: COMPOSTING OF THE VILLAGE CODE OF
THE VILLAGE OF ELK GROVE VILLAGE
WHEREAS, the Recycling and Waste Committee of the Village of Elk Grove Village, at
a public meeting duly called and held according to law, considered the question of Composting
in the Village; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after
having considered the recommendation and finding of said Recycling and Waste Committee,
find and believe it to be in the best interest of the Village to amend the provisions for
Composting in the Village.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
Village of Elk Grove Village, an Illinois Home Rule Municipality, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That the second paragraph of Section 4-2-2(B) I of the Village Code be
amended to read as follows:
The provisions of this subsection B1 shall not be applicable to compostable materials
properly placed in a compost pile in conformance with section 4-4-6 of this title.
Section 2: That the first paragraph of Section 4-4-6 of the Village Code be amended as
follows:
4-4-6: COMPOSTING: Compostable materials such as grass, trimmings, wood
waste, leaves, weeds, fruits and vegetables, breads and grains, coffee grounds, egg shells
and other garden refuse may be placed in a compost pile, provided it is placed in such a
way so the material will not be windblown. The depositing of garbage, pet waste, meat
scraps or other materials that may attract animals or vermin to the compost pile, or which
may produce an obnoxious odor, shall be prohibited.
Section 3: Any person violating the provisions of this Ordinance shall be subject to a
fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each
offense, and a separate offense shall be deemed committed on each day on which a violation
occurs or continues to exist.
Section 4: That the Village Clerk is hereby authorized to publish this Ordinance in
pamphlet form.
Section 5: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
