Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on August 20, 2013, this Executive Session was
called to consider a Liti ation matter.

Litigation
The Mayor advised the Board that the Tour of Utah has moved forward .with a proposal to change
the start date of their race, which would impact the dates for the Toru- of Elk Grove which has been
held on the first weekend in August for the last eight (8) years. Moving the Tour of Elk Grove
would create conflicts with the seven schools on our course, and also conflict with the other local
and regional events such as the Arlington Million.
USA Cycling and the International Cycling Union recently announced that they will allow the
Tour of Utah to expand its race. The Tour of Utah will now include a road stage and have a Cull
seven days of racing, conflicting with the race dates of the Tour of Elk Grove.
The Mayor stated that the decision was made with the knowledge that the Tour of Utah will
essentially be assuming our road race date. It is believed that USA Cycling and UCI felt that we
would change our race date even though they were advised otherwise.
In 2014, the Tour of Utah will be starting on a Monday. With the Monday start date, it will be
impossible for Elk Grove's top-tier pro teams to participate in both the Tour of Elk Grove and
Tour of Utah races at the highest levels.
• The Mayor advised USA Cycling that the Village has retained legal counsel and that the Village
would be exploring legal options to stop the Tour of Utah from taking the Tour of Elk Grove's
race dates.
The consensus of the Village Board was to nm a full-page ad in the front section of the Daily
Herald's Sunday edition at a cost of$5,700. It was also the consensus of the Board to run a full-
page ad in the Elk Grove Journal.
Should the UCi change the dates back to what the Village has requested, Elk Grove Village will
continue to hold the Tour of Elk Grove.
The Mayor advised the Board that he would be contacting Matt Wakely at Alexian Brothers on
Friday, August 23, to advise him of the announcement that would be taking place on Sunday.
