Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on September 10, 2013, this Executive Session was
called to consider a Utkzation matter.

Litigation
The Village Board was advised that USA Cycling was put on notice that it is their decision on
whether the Tour of Elk Grove continues or not. UCI has stated that their schedule will follow the
lead of the USA Cycling. The Village Board was farther advised that there is a chance that USA
Cycling will back down due to the fact that they have not yet released the 2014 racing calendar,
and the Village may litigate the unfair change in dates.
