A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO
EXECUTE A LETTER OF UNDERSTANDING BETWEEN THE STATE OF ILLINOIS
DEPARTMENT OF TRANSPORTATION (IDOT) AND THE VILLAGE OF ELK
GROVE VILLAGE FOR MAINTENANCE RESPONSIBILITIES FOR THE
ELMHURST / HIGGINS / TOUHY INTERSECTION IMPROVEMENT PROJECT
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows:
Section 1: That the Mayor be and is hereby authorized to sign the attached documents
marked:

a copy of which is attached hereto and made a part hereof as if fully set forth and the Village
Clerk is authorized to attest said documents upon the signature of the Mayor.
Section 2: That this Resolution shall be in full force and effect from and after its passage
and approval according to law.

Dear Ms. Murphy:
This Letter of Understanding (LOU) has been prepared to outline the mutual
understanding between the Village of Elk Grove Village referred to as the LPA and
the State of Illinois, acting by and through its Department of Transportation,
hereinafter referred to as STATE and shall serve as a written record of the
maintenance responsibilities for the subject project.
Please indicate the LPAs concurrence by signing with original signature and return
four (4) copies with original signatures to our office for final processing. The signed
copy will be included as an exhibit in the Local Agency Agreement with Cook
County.
The STATE and Cook County jointly propose to improve the above -referenced
location; the conditions of our mutual understanding are that:
1. All traffic control equipment to be used in the traffic signal work
Included herein must be approved by the STATE prior to its installation.
The STATE must be notified a minimum of seven (7) working days prior
to the final inspection. Final inspection of the signalized intersection will
be made by a representative of the STATE, and, If satisfactory,
authorization for turn on will be given.
2. Upon acceptance of the traffic signals by the STATE the financial
responsibility for maintenance and electrical energy for the operation of
the traffic signal at the intersection shall be proportioned as follows:

and become a part of the current Master Agreement between the Village
of Elk Grove Village and the STATE.
3. The actual maintenance of traffic signals at the above intersections
will be performed by the STATE with Its own forces or through ongoing
contractual agreement.
4. The financial responsibility for the maintenance of the "Emergency
Vehicle Preemption" equipment at the signalized Intersection above and
the LED illuminated street name signs shall be borne by the LPA.
5. The STATE retains the right to control the sequence and timing of the
traffic signals and interconnect.
6. Payment by the STATE of any or all of its share of maintenance is
contingent upon the STATE receiving adequate funds in its annual
appropriation.
7. It is mutually agreed, if, in the future, the STATE adopts a roadway or
traffic signal improvement passing through the signalized intersections
which requires modernization or reconstruction to sold traffic signals and
then LPA agrees to be financially responsible for all casts to relocate or
reconstruct the LED illuminated street name signs and the emergency
vehicle ,pre-emption equipment with the STATE`s proposed improvement.
All costs associated with the installation, future maintenance, or
replacement of non-standard STATE equipment, finish or hardware shall
be the sole responsibility of the LPA. This Includes, but is not limited to,
painting of the signal hardware, aesthetic poles, audible pedestrian
signals, etc. The LPA shall be required to use the STATE's electrical
maintenance contractor to perform maintenance functions or apply for a
highway permit to do this work.
8. The LPA agrees to assume responsibility for the administration, control,
reconstruction and maintenance of the sidewalks, detectable warnings,
shared -use path, water mains and its appurtenances, and retaining walls.
The LPA further agrees to indemnify and hold harmless the State, its officers,
employees, and agents from any and all claims, lawsuits, actions, costs, and
fees (including reasonable attorney fees and expenses) of every nature and
description arising from, growing out of, or connected with the operation of
the said Items.
9. Upon acceptance by the STATE, the jurisdiction, ownership and maintenance
of the roadway lighting along Touhy Avenue from approximately Station 531+00
to 580+00, the transitional lighting on Mt. Prospect Road just north of the Touhy
Avenue Intersection, the lighting along Old Higgins Road from Touhy Avenue
Intersection to approximately Station 824+75 and the combination lighting at the
following intersections.
Elmhurst Road at Touhy avenue
Elmhurst Road at Estes/ Old Higgins Road
Touhy avenue at Old Higgins Road
Touhy avenue at Mt. Prospect Road
will be the responsibility of the STATE
10. Upon acceptance by the STATE, the jurisdiction, ownership, energy and
maintenance of all roadway and decorative lighting within Its municipal limits
except lighting described in Item #9 above will be the responsibility of the LPA
All provisions, conditions, restrictions and requirements of this agreement
shall be binding upon and inure to the benefit of the successors, assigns,
administrators, executors or heirs of the parties hereto
