AN ORDINANCE REZONING PROPERTY SUBSTANTIALLY IDENTIFIED AS THE
DEVON AVENUE MARKET FROM B-1 BUSINESS DISTRICT TO THE I-1
RESTRICTED INDUSTRIAL DISTRICT SUBJECT TO CERTAIN CONDITIONS AND
GRANTING CERTAIN VARIATIONS FROM THE ZONING ORDINANCES AND THE
VILLAGE CODE (CA INDUSTRIAL HOLDINGS)
WHEREAS, the Plan Commission of the Village, at a public hearing duly called and
held according to law, considered the rezoning of property located in the vicinity of 552-586 E.
Devon Avenue from the 13-1 Business District to the I-1 Restricted Industrial District and the
granting of certain variations of the Zoning Ordinance; and
WHEREAS, the Mayor and Board of Trustees, after reviewing the findings and the
recommendations of the Plan Commission, find and believe it to be in the best interests of the
Village that the property be rezoned to the I-1 Restricted Industrial District together with the
granting of variations of the Zoning Ordinance and Village Code as recommended by the Plan
Commission and subject to various development conditions as further recommended by the Plan
Commission.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the property substantially located at 552-586 E. Devon Avenue, Elk
Grove Village, Illinois and identified as the Devon Avenue Market be and the same is hereby
rezoned from the 13-1 Business District to the I-1 Restricted Industrial District which property is
legally described as follows:
Lot 1 in the Devon and Tonne Resubdivision, being a resubdivision of part of the south
1/2 of the southeast quarter of Section 33, Township 41 North, Range 11 East of the Third
Principal Meridian, in Cook County, Illinois.
Section 2: That pursuant to Public Hearing and the recommendation and findings of the
Plan Commission, the Village hereby grants the following variations of the Zoning Ordinance
and the Village Code:
a. A variation of Section 7E-9:A of the Zoning Ordinance to increase the permitted
height of the screen wall from six feet (6') to twelve feet (12').
b. A variation of Section 8-12B-1-1-D of the Village Code to allow placement of the
screen wall within the ten foot (10') rear yard public utility easement.
A variation of Section 7-1, Schedule of Bulk and Yard Requirements and
Regulations and Section 713-1-3:13 of the Zoning Ordinance to reduce the required
rear -yard setback from fifty feet (50') to forty-three feet (43').
d. A variation of Section 7-1 Schedule of Bulk and Yard Requirements and
Regulations of the Zoning Ordinance to increase the permitted building height
from thirty-five feet (35') to sixty feet (60').
Section 3: The granting of the Rezoning is subject to the following initial conditions,
which conditions must be met prior to the issuance of a certificate of occupancy for the building.
a. The industrial facility shall be constructed in compliance with all Village Codes
and in substantial conformance with the following plans submitted by the
Petitioner:
Site Plan prepared by Kimley Horn dated 3/13/19.
ii. Conceptual Site Plan "Option B" prepared by Harris Architects, Inc,
with date of receipt of 2/4/2019.
iii. Landscape Plan prepared by Kimley Horn, dated 3/13/2019.
iv. Conceptual Architectural Exhibits for Office -Warehouse Facility
prepared by Harris Architects, Inc, with date of receipt of 2/4/2019.
b. The planned improvements to the adjacent shopping center shall be completed,
including:
Repaving the parking lot;
ii. Roof replacement; and
iii. Exterior work in substantial conformance with the Conceptual
Architectural Exhibits for Office -Warehouse Facility prepared by
Harris Architects, Inc, with date of receipt of 2/4/2019.
A Plat of Easement shall be recorded providing emergency access for the Village
from the James Paul Petri Public Works Facility at 450 E. Devon Avenue through
both properties to access Tonne Road.
d. The Petitioner shall enter into a shared parking agreement with the Elk Grove
Park District to allow users of Muir Park to utilize parking spaces in the retail
center on evenings and weekends.
Section 4: The granting of the Rezoning is further subject to the following secondary
conditions:
a. The Petitioner shall construct, at their expense, an extension of the existing
pedestrian/bicycle path located north of the property to connect to the proposed
sidewalk in the northeast corner of Lot 1, subject to the cooperation of the Elk
Grove Park District and ComEd.
b. The variation from Section 8-1213-1-1-1) of the Municipal Code to allow
placement of the screen wall within the rear yard ten foot (10') public utility
easement is granted with the condition that utility waivers must be submitted to
the Community Development Department prior to the start of construction.
c. Any building constructed on the new industrially zoned property now or in the
future shall conform to the following conditions:
1. The building shall be screened from the residential property to the
north with a screen wall, fencing and landscaping in substantial
conformance with the Site Plan and Landscape Plan.
2. There shall be a maximum of 18 truck docks, which shall be located
on the west side of the building and be partially enclosed with
extensions of the building to provide additional noise and visual
screening from both the residential properties to the north and Devon
Avenue to the south.
Section 5: That the Village Clerk is hereby directed to amend the zoning map of the
Village to reflect the rezoning as set forth herein.
Section 6: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
