HomeMy WebLinkAboutORDINANCE - 3612 - 5/28/2019 - Magic Trucks - AutomotiveORDINANCE NO. 3612 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE BY ADDING NEW AUTO SALES, RENTAL AND MAINTENANCE FACILITIES AS A SPECIAL USE IN THE B-3 AUTOMOTIVE BUSINESS DISTRICT, AND REZONING PROPERTY AT 228 E. DEVON AVENUE FROM R-3 RESIDENTIAL TO B-3 BUSINESS AND GRANTING A SPECIAL USE TO SAID PROPERTY FOR AN AUTO SALES, RENTAL AND MAINTENANCE FACILITY AND THE GRANTING OF SEVERAL VARIATIONS OF THE ZONING ORDINANCE WITH RESPECT TO MINIMUM LOT WIDTHS, BUILDING SETBACKS AND MAXIMUM HEIGHTS OF FENCES (MAGIC TRUCKS) WHEREAS, the Plan Commission of the Village of Elk Grove Village considered the question of amending the Zoning Ordinance to permit Auto Sales, Rental and Maintenance Facilities as a Special Use in the B-3 Automotive Business District, and granting a Special Use to Magic Trucks for an auto sales, rental and maintenance facility for property located at 228 E. Devon Avenue in the Village, together with various variations of the Zoning Ordinance as deemed necessary to properly develop the facility; and WHEREAS, the Mayor and Board of Trustees, after having reviewed the recommendation and finding of said Plan Commission, find and believe that the text amendment and the granting of the Special Use Permit together with the associated variations, is in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 713-3-2 (E) Special Uses in the B-3 Automotive Oriented Business District be amended by adding thereto the following: New auto sales, rental and maintenance facilities to be located east of I-290 and west of Tonne Road along Devon Avenue. Section 2: That the property located at 228 E. Devon Avenue be rezoned from the R-3 Residential District to the B-3 Automotive Oriented Business District subject to the following conditions: That the Plat of Easement granting an easement for underground public utilities prepared by Chamberlin/Masse and received by the Village on April 8, 2019 be recorded by Petitioner with the Cook County Recorder of Deeds within two months of the approved date of this Ordinance and a stamped, recorded copy of same be provided to the Village Clerk. 2. That the property be connected to a future lift station, if any, constructed by the Village to service the property within one year from the completion date of the construction. Section 3: That there be granted a Special Use Permit to Magic Trucks, for an auto sales, rental and maintenance facility for property located at 228 E. Devon Avenue, Elk Grove Village, subject to the following conditions: 1. The facility shall be constructed within twelve months from the approved date of this Ordinance and shall be in compliance with all Village Codes, except as varied herein, and be in substantial conformance with the following plans: a. Site Plan prepared by JTS Architects dated April 8, 2019. b. Landscape Plan prepared by JTS Architects dated April 8, 2019. c. Elevations prepared by JTS Architects received by the Village on July 18, 2018. 2. The property shall be screened with a ten foot (10) fence along the north property line and a seven foot (T) fence along the west property line, which fences shall be board -on- board wooden panels with metal posts. 3. That the Special Use herein granted is exclusive to Magic Trucks. Section 4: That pursuant to Public Hearing and recommendations and findings of the Plan Commission, the following variations of the Zoning Ordinance are hereby granted: a. Variation of Section 7-1 of the Zoning Ordinance which requires a minimum lot width of one hundred fifty feet (150) to permit a lot width of one hundred, twenty-four feet (124'). b. Variation of Section 7-1 of the Zoning Ordinance which requires a seventy-five foot (75') setback when adjacent to a residential zoned district to permit a thirty-seven foot (37) building setback. c. Variation of Section 7B-3-4 of the Zoning Ordinance which limits a fence to a maximum height of six feet (6) to permit a seven foot (T) fence along the west property line and a ten foot (10') fence along the north property line. Section 5: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES:6 NAYS:0 ABSENT:O PASSED this 28'h day of May 2019.
