The petitioners Melissa and Paul Redmon, (Owners of Record), were sworn in and asked to state their case for requesting the zoning variations. The petitioner explained that they want to install a pool for their child's therapy. In order for the proposed pool to be installed per Village Zoning code, an underground ComEd service line would need to be relocated. The only location that a twenty-one foot (21') or twenty-four foot (24') pool to legally be allowed has an underground ComEd service line for the house installed in that location. The petitioners have consulted with ComEd and an electrician to consider electric line relocation costs if the proposed pool were located to the South corner of their property and found the cost to be excessive. The only other location to allow the pool to be installed without relocating the ComEd line would be on the North side of the yard, in a location that is considered a front yard due to the property being located on a corner lot. Additionally, to allow the pool to fit in this location, the fence would need to be extended towards the sidewalk due to Village Zoning restrictions for fence location requirements. Chairman Childress opened the meeting to questions from the board. Member Bacigalupo asked if the petitioner contacted the neighbors directly behind their property to determine if they had any objections to the pool and fence variations. Ms. Redmon said that they did not, but several other neighbors said that they would support the variance requests, and would write a letter supporting the request if they would like. (No letter was presented.) Member Kelley asked if a smaller pool, such as an eighteen foot (18') pool would fit in the area without moving the fence (and then would not be needing a variance for the fence location.) Ms. Redmon said that yes, a smaller pool would fit in that area. Member Dohrer commented that since there currently is a fence adjacent to the proposed location, extending the fence to the front of the house would not negatively affect sight lines on the street. Chairman Childress called for the motion. A motion to DO GRANT the variations for the construction of a twenty-one foot (21') or twenty- four foot (24') pool located six feet (6') from the lot line within the required front yard along the North of the property and to extend the existing fence with a six foot (6') high privacy fence three feet (3') from the street side property line from the front of the house to the rear edge of house were made by Member Dohrer and was seconded by Member Serrano. Upon voting (AYES— Bacigalupo, Bookler, Childress, Colgan, Dohrer, Jameel, Kelley, and Serrano.) (NAYES — None.) (ABSTAIN — Romanski.) The motion carried. Chairman Childress advised the petitioners to contact the Village Clerk and attend the subsequent Village Board Meeting.
