AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO 1400 BUSSE, LLC TO
CONSTRUCT AND OPERATE A JIMMY JOHN'S DRIVE-THRU RESTAURANT FOR
PROPERTY LOCATED AT 1420-1428 BUSSE ROAD, ELK GROVE VILLAGE
WHEREAS, the Plan Commission of the Village of Elk Grove Village, sitting as a
Zoning Commission, considered the question of granting a Special Use Permit to 1400 Busse,
LLC to construct and operate a Jimmy John's drive-thru restaurant for property located at 1420-
1428 Busse Road, Elk Grove Village, Illinois, which property is located in a B-2 General
Business District; and
WHEREAS, the Mayor and Board of Trustees, after having reviewed the
recommendation and finding of said Plan Commission, find and believe that it is in the best
interest of the Village to grant the Special Use as conditioned by the Plan Commission;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a Special Use Permit to 1400 Busse, LLC to permit the
construction and operation of a Jimmy John's drive-thru restaurant in a B-2 General Business
District for property located at 1420-1428 Busse Road, Elk Grove Village, Illinois subject to the
following conditions:
1. The site/facility shall be constructed in compliance with all Village Codes and in
substantial conformance with the following plans submitted by the Petitioner:
a. Site Plan prepared by Vari Johnson Architects, Ltd with date of receipt of
9/12/2019;
b. Landscape Plan prepared by Vari Johnson Architects, Ltd, with date of receipt of
8/28/2019; and
c. Elevations with date of receipt of 8/28/2019.
2. The Petitioner shall be required to remove the existing pole sign and construct a new
monument sign in substantial conformance with the Signage Plan prepared by Vari
Johnson Architects, Ltd with date of receipt of 8/28/2019.
Section 2: That this Special Use Permit is only valid for 1400 Busse, LLC (Jimmy
John's) at 1420-1428 Busse Road and expires at the time that Jimmy John's is no longer located
at the subject property.
Section 3: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
