AMENDMENT TO WATER SUPPLY AGREEMENT BETWEEN
NORTHWEST SUBURBAN MUNICIPAL JOINT ACTION WATER
AGENCY AND THE VILLAGE OF ELK GROVE VILLAGE
DATED DECEMBER 31, 1982
The Northwest Suburban Municipal Joint Action Water Agency and the
Village of Elk Grove Village agree as follows:
Section 1: BACKGROUND.
(a) The Agency and each of its Member Municipalities have entered
into Water Supply Agreements dated December 31, 1982.
(b) Each of those Agreements contain provisions for the Agency to
maintain water storage capacity outside the corporate limits of
the City of Chicago.
(c) It is now desired by the Agency and each of the Member
Municipalities to amend Section 402(b) of that Agreement to
establish the requirement for the Agency to maintain storage
capacity outside the corporate limits of the City of Chicago at a
fixed amount of 10 million gallons.
Section 2: AMENDMENT.
Section 402(b). The Water Supply Agreement between the Agency and
the Village of Elk Grove Village is amended to read as follows:
(b) The Agency shall provide and maintain at
all times water storage capacity as follows:
(i) As part of the Agency System outside of
the present corporate limits of the
City of Chicago, a water storage capacity
of not less than 10 million gallons.
(ii) As part of the Agency System within
the present corporate limits of the City
of Chicago, a water storage capacity of not
less than 20 million gallons.
Section 3: EFFECTIVENESS. This Agreement shall be effective when
identical amendments have been entered into by the Agency and each
Member Municipality, and have been filed with the Secretary of the
Agency.
