HomeMy WebLinkAboutORDINANCE - 2489 - 5/14/1996 - ANNEX/SPECIAL USE/FIRE STATIONORDINANCE NO. 2489 AN ORDINANCE ANNEXING CERTAIN VILLAGE -OWNED TERRITORY TO THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, there exists certain territory which is contiguous to the corporate limits of the Village of Elk Grove Village, the legal title to said territory having now been conveyed by two se- parate Warranty Deeds to the Village of Elk Grove Village from Allen Busse; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village have deemed it in the best interest of the Village that said Village -owned territory be annexed to the Village pursuant to Chapter 65, Section 7-1-9 of the Illinois Compiled Statutes, (65 ILCS 5/7-1-9), all proper notice having been made. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the following legally -described territory, which is now owned by the Village of Elk Grove Village, and which is uninhabited, unincorporated and contiguous to the corporate limits of the Village of Elk Grove Village, be and the same is here- by annexed to the Village of Elk Grove Village together with any adjacent highways and rights-of-way so that said territory be in- cluded within the boundary and corporate limits of the Village of Elk Grove Village as provided by law: That part of the Southwest Quarter of Section 22, Town- ship 41 North, Range 11, East of the Third Principal Meridian described as follows: Commencing at the South- west corner of Lot 58 in Higgins Industrial Park Unit 40, being a Subdivision in the Southeast Quarter of Sec- tion 22, Township 41 North, Range 11, East of the Third Principal Meridian; thence North 00 degrees 40 minutes 36 seconds East along the West line of Lot 58 (being the East line of the Southwest Quarter aforesaid) for a dis- tance of 6.83 feet to the point of beginning; thence continue North 00 degrees 40 minutes 36 seconds East along the last described line 235.89 feet; thence South 89 degrees 58 minutes 20 seconds West parallel with the South line of said Southwest Quarter 354.76 feet; thence South 00 degrees 40 minutes 36 seconds West parallel with the East line of the Southwest Quarter aforesaid for a distance of 437.68 feet to the North line of Oak - ton Street as dedicated per document #9967968; thence North 89 degrees 58 minutes 20 seconds East along the said North line 117.61 feet to the Northwesterly line of Commonwealth Edison right of way; thence North 49 degrees 52 minutes 26 seconds East along said right of way line 313.27 feet to the point of beginning, in Cook County, Illinois. ALSO That part of Oakton Street lying South of and adjoining the above described property and lying North of the South line of the Southwest Quarter aforesaid and lying North- westerly of the Northwesterly line of Commonwealth Edison Company right of way, in Cook County, Illinois Permanent Index Number: 08-22-303-004-0000 (Underlying Parcel) Address: Vacant 3.1163 acres on the North side of Oakton Street near Bonnie Lane, Elk Grove Village, Illinois Section 2: That upon annexation said land and territory shall be zoned I-1 Industrial according to the zoning as designated on the Comprehensive Plan. In addition, a Special Use Permit for the I-1 District is hereby granted to permit the annexed property to WAS be used as a government building. Any and all procedural require- ments, including, but not limited to, the holding of a public hear- ing as a condition of the issuance of said Special Use Permit is hereby expressly waived. Section 3: That the Village Clerk of the Village of Elk Grove Village is hereby authorized and directed to amend the official map of the Village to incorporate the annexation and rezoning of the territory as set forth herein, and to record a certified copy of this Ordinance together with a plat of said territory, (Map of An- nexation), with the Recorder of Deeds of Cook County, said Map at- tached hereto and incorporated herein as Exhibit A. Section 4: That the Village Clerk is further directed to file a certified copy of this Ordinance with the County Clerk and the County Election Authority in Cook County, Illinois. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 14th day of May 1996. APPROVED this 14th day of May , 1996.
