AN ORDINANCE REZONING 5,200 SQUARE FEET OF PROPERTY ADJACENT
TO OUTLOT NUMBER 1 OF VACANT PROPERTY LOCATED ON BIESTERFIELD
ROAD, APPROXIMATELY 375 FEET EAST OF WELLINGTON AVENUE,
FROM B-2 GENERAL BUSINESS TO B-3 AUTOMOTIVE ORIENTED
BUSINESS (GULLO DEVELOPMENT CORPORATION - BOSTON MARKET)
WHEREAS, the Plan Commission of the Village of Elk Grove Vil-
lage at a public hearing duly called and held according to law con-
sidered the question of granting rezoning to 5,200 square feet of
property adjacent to Outlot 1 of that property located on Biester-
field Road approximately 375 feet East of Wellington Avenue; said
rezoning being from the B-2 General Business District to the B-3
Automotive Oriented Business District to conform with that zoning
already granted for Outlot 1; and
WHEREAS, the President and Board of Trustees after having
considered the recommendation of said Plan Commission find and be-
lieve it to be in the best interest of the Village to grant the
rezoning as requested subject to certain conditions with respect
to the development of the subject property.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That the certain property adjacent to Outlot 1
of that certain vacant property located on Biesterfield Road ap-
proximately 375 feet East of Wellington Avenue, which property is
legally described on Exhibit A, attached hereto, be and the same
is hereby rezoned from B-2 General Business District to the B-3
Automotive Oriented Business District, subject to the conditions
set forth hereinafter.
Section 2: That the property as rezoned shall permit a drive-
thru restaurant as approved by the President and Board of Trustees
for the Boston Market Company, which Company shall meet the follow-
ing requirements:
A. Use of reddish -brown brick and split -face block,
and golden yellow dry-vit on building as depicted
on color rendering dated June 21, 1996 on file in
the Office of the Village Clerk;
B. Installation of 31� inch diameter trees throughout
the site as depicted on a landscape plan dated June
21, 1996 on file in the Office of the Village Clerk;
and
C. Compliance with restrictions previously placed on
the property by Ordinance No. 2434 with respect
to back lit lettering, landscaping and window signs.
Section 3: That the Amended Site Plan for the subject pro-
perty, approved by Ordinance No. 2456, be and the same is hereby
amended and a Second Amended Site Plan dated June 11, 1996 is here-
by approved, copies of which are on file in the Office of the Vil-
lage Clerk.
Section 4: That the Village Clerk is hereby directed to amend
the Official Zoning Map of the Village to incorporate the changes
set forth herein.

Section 5: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
