ORDINANCE NO. 1268
AN ORDINANCE AUTHORIZING THE VILLAGE PRESIDENT
AND VILLAGE CLERK TO EXECUTE A DEED OF SALE OF
VILLAGE OWNED REAL ESTATE
WHEREAS, the Village of Elk Grove Village is a home rule
municipality, as established and defined by the Constitution of
the State of Illinois; and
WHEREAS, the Village of Elk Grove Village, pursuant to its
home rule authority, adopted Ordinance No. 1214 on April 25, 1978,
which Ordinance authorized the Village to convey the hereinafter
described real property by negotiation and contract; and
WHEREAS, pursuant to Ordinance No. 1214, the Village did
negotiate a sales contract with the Woodrow Equipment Company of
Cincinnati, Ohio, and duly adopted Ordinance No. 1233 on August 8,
1978, authorizing the execution of said contract; and
WHEREAS, the President and Board of Trustees did further
adopt Ordinance No. 1262 on November 28, 1978, which Ordinance
provided for the amendment of said contract and acknowledged the
assignment of Woodrow Equipment Company's interest in said contract
to the Strickland Transportation Company of Cincinnati, Ohio; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village have determined that it is no longer necessary,
appropriate or in the best interests of the Village that it retain
title to said real estate, and that said real estate is not required
for the use of, or profitable to, the Village; and
WHEREAS, the Village of Elk Grove Village, as a home rule
municipality, has the authority to make a lawful conveyance of said
property, and has fulfilled all statutory requirements imposed on
home rule municipalities;
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk drove Village, Counties of Cook
and Du Page, Illinois, as follows:
Section 1: That the Village President and Village Clerk are
hereby authorized to execute a proper deed of conveyance, thereby
conveying approximately 34.6 acres of real estate located at the
southeast corner of Busse Road and Landmeier Road, Elk Grove Village,
and legally described on said deed, a copy of which is attached
hereto, and incorporated herein, to the Strickland Transportation Company
of Cincinnati, Ohio.
Section 2: That the Village President and Village Clerk are
hereby authorized, respectively, to execute and attest such other
documents as may be necessary to effectuate the conveyance herein
authorized.
Section 3: That this Ordinance shall be in full force and
effect from and after its passage, by a vote of at least three-fourths
(3/4) of the Corporate Authorities now holding office, and approval
in the manner provided by law.
