AN ORDINANCE TO CONTINUE TO rF.QUIRE CERTAIN
MANUFACTURING MACHINERY AND EQUIPMENT TO BE
SUBJECT TO THE RETAILERS OCCUPATION TAX
AND SERVICE OCCUPATION TAX
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, at a public meeting duly called and held
according to law, considered the issue of continuing to require certain
manufacturing machinery and equipment to. be subject to the Retailers
Occupation Tax and Service Occupation Tax; and
WHEREAS, SB 736 (Public Act 80-1292), effective August 2,
1978, has been adopted by the Illinois General Assembly; and
WHEREAS, said amendments provide that certain described
manufacturing machinery and equipment is excluded from the
Retailers Occupation Tax and the Service Occupation Tax; and
WHEREAS, it is the desire of the Village of Elk Grove Village
that such machinery and equipment remain subject to said taxes.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and Du Page, Illinois, as follows:
Section 1: That Article XLV, Municipal Retailers Occupation
Tax, of the Municipal Code of the Village of Elk Grove Village,
be and is hereby amended by adding thereto a new Section 18.4504
to read:
Section 18.4504. Exemption (d) contained in
Section 2 of the "Retailers Occupation Tax Act", approved
June 28, 1933, as amended, shall not apply to property
within the Village of Elk Grove Village, Illinois.
Section 2: That Article XLVI, Municipal Service Occupation
Tax, of the Municipal Code of the Village of Elk Grove Village,
be and is hereby amended by adding thereto a new section 18.4604,
to read as follows:
Section 18.4604. Exemption (e) under "Sale of Service"
contained in Section 2 of the "Service Occupation Tax Act,
approved July 10, 1961, as amended, shall not apply to
property within the Village of Elk Grove Village.
Section 3: That this Ordinance shall be in full force and
effecy from and after its passage, approval and publication
according to law.
