ORDINANCE NO. 1350
AN ORDINANCE AMENDING CHAPTER 22A WATER
AND SEWER OF THE MUNICIPAL CODE OF THE
VILLAGE OF ELK GROVE VILLAGE PERTAINING
TO THE PAYMENT OF WATER AND SEWER SERVICE
BILLS AND THE REQUIREMENT OF DEPOSITS
WHEREAS, the Village of Elk Grove Village, has experienced
certain difficulties with respect to the collection of water and
sewer service bills; and
WHEREAS, after an extensive review of the delinquencies
and the nonpaid bills, it is apparent that a vast majority of
said delinquencies are related to property which is rented in
the Village;
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois, as follows:
Section 1: That Section 22A102 - Applications of
Chapter 22A Water and Sewer of the Municipal Code of the Village
of Elk Grove Village be and the same is hereby amended to read
as follows:
22A102 Applications/Deposits.
Applications for water and/or sewer service shall be made,
in writing, to the Elk Grove Village Finance Department and
shall contain an agreement by the applicant to abide by the
Ordinances of the Village including provisions contained in this
Chapter and in Section 8.005 of this Municipal Code. Failure
to file this application may result in termination of service
to the property.
Where the property to be served is rented or leased or
the applicant is not the owner of the premises, a deposit for
water shall be made with each such application, this sum to be
retained by the Village to insure payment of all water and/or
sewer charges due the Village. The deposit shall be based on
meter size in accordance with the following schedule:

4" or Larger 500.00
In addition, a deposit shall be required in all cases where
service is terminated for non-payment or delayed payment as a
guarantee for the payment of future water and sewer bills. When
service to the applicant is discontinued permanently, this
deposit, less any amount still due the Village for water and/
or sewer service shall be refunded without interest.
Section 2: That Section 22A702 of the Municipal Code
be and the same is hereby amended to read as follows:
Delayed Payment Charge/Returned Checks
An additional charge amounting to ten percent (10%) of
the bill will be added to the bill for water and/or sewer
service if not paid on or before the due date of the bill.
If any check deposited with the Village for payment of
the water and sewer bill is returned unpaid from the bank on
which it is drawn, an additional charge of Five Dollars ($5.00)
shall be charged.
Section 3: That Section 22A703 Nonpayment of the Muni-
cipal Code be and the same is hereby amended to read as follows:
The water supply may be shut off from any premises for
which the water and/or sewer bill remains unpaid after the due
date of the bill. When shut off, water shall not be turned on
again except upon a payment of Twenty-five Dollars ($25.00)
reconnection fee plus such other charges or deposits as are
required by the provisions of this Chapter.
Section 4: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
