AN ORDINANCE GRANTING A SIDE AND REAR YARD
VARIATION OF SECTION 5.1 OF THE ZONING
ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE
TO CHICAGO TITLE AND TRUST COMPANY, AS
TRUSTEE, UNDER TRUST NUMBER 46221, AND THE
VALE DEVELOPMENT COMPANY
WHEREAS, the Zoning Board of Appeals of the Village of Elk
Grove Village, at a public meeting duly called and held according to
law, considered the question of granting a rear and side yard variation
of Section 5.1 of the Zoning Ordinance to permit the proposed construction
by retail stores on property located at the southwest corner of Meecham
Road and Biesterfield Road and legally described hereinafter; and
WHEREAS, the President and Board of Trustees, after having
considered the recommendation of said Zoning Board of Appeals, find and
believe that sufficient hardships exist so as to warrant the granting
of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
Du Page, Illinois, as follows:
Section 1: That there be granted a variation of Article 5,
Section 5.1, of the Zoning Ordinance, as it applies to required side
and rear yards to permit the construction of retail stores no less than
25 feet from the affected side and rear yards on property located at the
southwest corner of Meecham Road and Biesterfield Road, and legally
described as follows:
The South 320.00 feet of the North 370.00 feet of
the East 350.40 feet (all measured at right angles)
of the West half of the Northwest quarter of
Section 36, Township 41 North, Range 10, East of
the Third Principal Meridian, in Cook County,
Illinois.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication according to
law.
