A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO
EXECUTE AN AMENDMENT TO THE ANNEXATION AGREEMENT
BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND NATURAL GAS
PIPELINE COMPANY OF AMERICA PREVIOUSLY APPROVED PURSUANT
TO RESOLUTION NO. 42-03, THEREBY EXTENDING THE TERM OF THE
AGREEMENT FROM TEN (10) YEARS TO TWENTY (20) YEARS
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village, pursuant to Resolution No. 42-03 authorized the execution of an
Annexation Agreement between the Village of Elk Grove Village and Natural Gas
Pipeline Company of America, which Agreement had an original term of ten (10)
years; and
WHEREAS, on May 25, 2004, a Public Hearing was held by the Mayor
and Board of Trustees to consider amending said Annexation Agreement to
increase the term to twenty (20) years; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village find and believe it to be in the best interest of the Village that the
Annexation Agreement be amended as above set forth.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That the Mayor be and is hereby authorized to sign an
amendment to the Annexation Agreement between the Village of Elk Grove
Village and Natural Gas Pipeline Company of America, previously authorized
pursuant to Resolution No. 42-03 and the Village Clerk is authorized to attest
said document upon the signature of the Mayor, a copy of which Amendment is
attached hereto and made a part hereof.
Section 2: That this Resolution be in full force from and after its passage
and approval according to law.

AN AMENDMENT TO THE ANNEXATION AGREEMENT BETWEEN THE
VILLAGE OF ELK GROVE VILLAGE AND NATURAL GAS PIPELINE
COMPANY OF AMERICA (NGPL) PREVIOUSLYAUTHORIZED PURSUANT
TO RESOLTUION NO. 42-03 BY CHANGING THE TERM SET FORTH IN
PARAGRAPH 11 (D) TERM FROM TEN (10) YEARS TO TWENTY (20) YEARS
11 (D) Term:
This Agreement shall be binding upon the parties for a term of twenty (20)
years from the date of the original Annexation Agreement; provided, however,
that the Ordinance is adopted by the Village pursuant to Paragraphs 5 and 6 of
this Agreement shall continue in force after the term of this Agreement.
