AMENDEDORDINANCE NO. 1113 AN ORDINANCE AMENDING SECTION 8.005, REQUIRED IMPROVEMENTS FOR SUBDIVISIONS, AS IT PERTAINS TO AVAILABILITY OF VILLAGE OWNED WATER AND SEWER FACILITIES, AND CHAPTER 22A, WATER AND SEWER, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That that portion of Section 8.005 pertaining to the availability of Village owned water and sewer facilities to property located within the Village be and the same is hereby amended to read as follows: Availability Of Village Owned Water and Sewer Facilities To�roper y�L-oca�ecTF�7Je V1 7Tage. The Village shall make its water and sewer facilities available to all real estate now or hereafter located therein and A) The property owner(s) shall pay connection charges as provided in Chapter 22A of this Code. B) The property owner(s) shall provide water and sewer extension mains and water meters in accordance with the provisions of this Code and as deemed necessary by the Village Engineer. C) Subdividers and developers shall: (1). Construct and donate to the Village all extension mains, water distribution systems, including transmission mains made necessary by such extension, water meters, meter installation materials, sewage collection systems, including intercepter sewers made necessary by said extensions of the sewage collection systems and lift stations, if any. (2). Construct same in accordance with the Village Code relative thereto and in a manner satisfactory to the Village Engineer. (3). Pay all fees per acre designated at the time of annexation at the time the developer or owner(s) seeks a water connection in the areas hereinafter described: (a). An area bounded on the north by Biesterfield Road and the west by Rohlwing Road, on the south by Devon Avenue and on the east by the Village limits. Also, an area bounded on the east by Rohlwing Road and by the Village limits on the north, west and south (said area as shown on an area map attached as Exhibit A to Ordinance No. 668 and on file in the Village Clerk's Office) $117.00 per acre. D) That the Village shall in all instances determine the appropriate sizing of mains and required capacity of proposed water and sewer facilities necessary to serve any proposed subdivision. E) If the Village desires to increase the size or capacity of any portion or all of the sanitary sewer or water system proposed by the subdivider or developer in order to provide service to areas not located with or beyond the limits of said subdivision, the cost thereof in excess of the cost of the subdivider's or developer's proposed installation shall be refunded by the Village to the subdivider or developer on the following basis: (1). Prior to construction, the sub- divider or developer and the Village shall agree upon the location and acreage of the land which the excess capacity is designed to serve, and shall agree on the total. excess cost in dollars. (2). Any subdivider, developer or property owner(s) in the area, as established according to (1) above, for which the said excess capacity has been provided, shall pay to the Village the dollar cost of such excess capacity in the same proportion that the acreage of said subdivision, development or land bears to the total acreage for which the excess capacity was provided; whereupon the Village shall refund a like amount to the subdivider or developer providing said excess capacity. F) All persons connecting directly to any Village water and/or sewer main shall pay an inspection fee of $25.00 per connection. Section 2: That Article V, Sewer Rates of Chapter 22A, be and the same is hereby amended by renumbering present sections 22A.501 and 22A.502 to 22A.502 and 22A.503, respectively, and adding as new paragraph 22A.501, the following: 22A.501. Connection Charge. All property for which a building permit may hereafter be issued, except municipal buildings owned by the Village of Elk Grove Village, which require a new connection with any mains or pipes which are or hereafter may be constructed and used in connection with the Village sewer system, shall pay a connection charge of $25.00. - 2 - Secti.orr 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
