HomeMy WebLinkAboutORDINANCE - 1115 - 1/11/1977 - LIQUOR LICENSE AMENDEDORDINANCE NO. 1115 AN ORDINANCE AMENDING CHAPTER 18.1206, INSPECTIONS, EXAMINATIONS AND REVOCATIONS, OF ARTICLE 12, DEALERS IN ALCOHOLIC LIQUORS, OF CHAPTER 18 OF THE MUNICIPAL CODE OF VILLAGE OF ELK GROVE VILLAGE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That Section 18.1206, Inspections, Examinations and Revocations, of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended to read as follows: The Local Liquor Control Commissioner shall have the right to examine, or cause to be examined, under oath any applicant for a local license or for a renewal thereof, and to examine or cause to be examined the books and records of any such applicant. The Local Liquor Control Commissioner shall have the right to hold a hearing for any licensee upon whom notice of revocation or suspension has been served and to examine or cause to be examined the books and records of any such licensee; to hear testimony and take proof for his information in the performance of his duties, and for such purpose to issue subpoenas which shall be effective in any part of this State, all as provided and in the manner provided by law. If, after a hearing on an alledged violation, the Village President as Local Liquor Control Commissioner finds that there was any violation of the ordinances of the Village of Elk Grove Village or statutes of the State of Illinois, he may suspend or revoke any retail liquor dealers' license, and/or fine such licensee for any violation of any provision of this Article or for the violation of any State law pertaining to the sale of alcoholic liquor. 1. If the Commissioner determines to suspend such license, the term of the suspension shall not be less than one day nor more than 30 days. 2. If the Commissioner elects to fine such licensee, the amount of such fine shall not be less than .$50.00 nor more than $500.00. All proceedings before the said Local Liquor Control Commissioner shall be recorded and placed in a certified official record of such proceedings taken and prepared by a certified court reporter. Section 2: That this Ordinance shall be in full force and'effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J.
