HomeMy WebLinkAboutORDINANCE - 1052 - 4/13/1976 - RECAPTURE AGREEMENT DEVON AVEORDINANCE NO. 1052 AN ORDINANCE PROVIDING FOR THE RECAPTURE OF FUNDS EXPENDED BY THE VILLAGE OF ELK GROVE VILLAGE FOR EXTENSION OF WATER UTILITIES SUPPERCEDING ORDINANCE 878 WHEREAS, the Village of Elk Grove Village has heretofore determined that the best interest of the Village required that its water utilities be extended so as to provide for future connection thereto; and WHEREAS, the President and Board of Trustees of the Village hereby determine that the cost of said extensions should be recaptured when and if certain properties, generally described hereafter, which would benefit by said extensions subsequently annexed to the Village; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That should any of the property located within an area bounded on the west by the VFW property (Lot 18 Lumpp's Subdivision), on the east by the existing Village limit (which is approximately 560 feet west of Tonne Road at that point) on the south by Devon Avenue and on the north by a line approximately 408 feet north of Devon Avenue, subsequently annex to the Village of Elk Grove Village the owners of said property shall pay to the Village the sum of One Thousand Ten Dollars ($1,010.00) for each acre, or a pro -rata amount for a portion of an acre, as repayment for the Village's extension of said utilities system. Section 2: That should any of the property located within the area bounded on the west by Salt Creek, on the east by the VFW property (Lot 18 Lumpp's Subdivision), on the south by Devon Avenue and on the north by a line approximately 408 feet north of Devon Avenue, subsequently annex to the Village of Elk Grove Village the owners of said property shall pay to the Village the sum of Six Hundred Five Dollars ($605.00) for each acre, or a pro -rata amount for a portion of an acre, as repayment for the Village's extension of said utilities system. Section 3: That the payment provision provided above shall be made on or before the adoption of any ordinances annexing all or any portion of the property generally described above. Section 4: That the requirements contained herein shall be in addition to any and all other conditions of annexation required by applicable statutes, laws and ordinances and provisions of any Annexation Agreement hereinafter adopted. Section 5: That this ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 13th of April 1976. APPROVED this 13th of April 1976.
