HomeMy WebLinkAboutORDINANCE - 1077 - 7/13/1976 - SUB. & PROCEDURES APPROVAL OF PLATSORDINANCE 1077 AN ORDINANCE AMENDING CHAPTER 8, SUBDIVISIONS, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE RELATING TO THE PROCEDURE FOR APPROVAL OF SUBDIVISION PLATS AND APPROVAL OF ONE -LOT SUBDIVISIONS NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois, as follows: SECTION 1: That Section 8.007, Procedure for Approval of Subdivision of Chapter 8, Subdivisions, of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended to read as follows: 8.007 - Subdivision Procedures.) A. Specific Areas of Responsibility for processing Subdivision Plats: 1. The Village Manager is to coordinate and monitor all steps in the process and to keep the President and Board of Trustees informed. 2. The Village Clerk is to maintain the official file of formal documents, to secure signatures as required and to record the final plat of subdivision. 3. The Village Manager is to review, in consultation with the appropriate Village Department Heads, the proposed subdivision and public improvements for com- patibility with existing conditions and impact on municipal services. 4. The Director of Public Works/Engineering is to review all supporting documents submitted with the final plat to assure that they are in accordance with Village standards and sound engineering practice. 5. The Plan Commission is to review the proposed development in terms of the Comprehensive Plan, Official Map, and Zoning Classification with special emphasis given to traffic patterns; preservation of natural resources; location of open space and water retention; location of recreational facilities and schools; housing types; and harmony of development with bordering sections of Village and bordering communities. 6. The President and Board of Trustees is to act on the recommendation of the Plan Commission and JPZ Committee of the Village by either approving or denying the request for subdivision; however, as a general rule, one -lot/ single -use subdivisions need not be reviewed by the JPZ (Judiciary, Planning & Zoning) Committee. B. Procedures for Approval of Subdivision Plats: 1. Pre -Application Sketch Plan Phase a. The Village Manager will arrange a meeting between the petitioner and the Plan Commission for the purpose of discussion of a sketch plan (does not have to be to scale) of the proposed development, showing zoning, traffic patterns and the location of open space, water retention, recreational facilities, schools and relation- ship to the Village boundaries. b. The Plan Commission, after reviewing the sketch plan, will submit the petitioner its recommendations for change, if any. c. When agreement is reached between the Plan Comm- ission and the petitioner on the sketch plan, verified by written communication from the Plan Commission to the Village Manager, the petitioner will be advised by the Village Manager that a preliminary plat must be submitted within four (4) months in reasonable accord with the agreed -to sketch plan. 2. Preliminary Plat Phase a. All preliminary plats of subdivision and their required number of copies (8) are to be submitted to the Village Manager with a letter of transmittal. Incomplete inquiries will be returned to the developer for his action. b. The Village Manager will forward one copy of the Preliminary Plat and all application/general informa- tion to the Village Clerk and all operating departments. c. All Department Heads, after reviewing the material, will submit to the Village Manager a written report of their findings and a detailed account of additional information their department feels is still needed. d. The Village Manager will compile a consolidated report of the Department Heads' findings and will submit this report along with the plat and accompanying information to the Plan Commission for its approval or disapproval. e. The Plan Commission shall: 1. If the plat as submitted is approved, officially stamp and sign the plat and return to the Village Manager. 2. If the plat as submitted is not acceptable, return it to the Village Manager with a written communication indicating what further action or information is needed by the developer. -2- f. The Village Manager shall: 1. If the Plan Commission approves the plat, return an approved copy along with a copy of the final plat check list to the petitioner with a letter of transmittal advising that the Preliminary Plat is approved and that a Final Plat must be submitted within four months in strict accordance with the approved Preliminary Plat. 2, If the Plan Commission rejects the plat, advise the petitioner of what revisions or additional information is needed for reconsideration by the Village. 3. Final Plat Phase a. All final plats of subdivision, and their required number of copies (8),are to be submitted to the Village Manager with a letter of transmittal. Incomplete inquiries will be returned to the developer for his action. b, The Village Manager will forward one copy of the Final Plat, application/general information, to the Village Clerk and all operating departments. Engineering and supporting documents shall be sent to the Director of Public Works/Engineering. c, All Department Heads, after reviewing the material, will submit to the Village Manager a written report of their findings. d. The Village Manager will compile a consolidated report of the Department Heads, findings and will submit this report along with the plat to the Plan Commission for its review in preparing a recommendation to the Village Board. e. The Plan Commission shall: 1. If the plat as submitted is approved, officially stamp the plat and forward to the Village Board through the Village Manager. 2. If the plat as submitted is not acceptable, return it to the Village Manager with a written communication indicating what action or information is needed by the developer. f. If Step e-1 occurs, the plat (consisting of more than one lot or multiple uses) will automatically be referred to the JPZ Committee for its review and a recommendation to the Village Board. g. The Village Board shall: 1. Approve the plat of subdivision and authorize the Village President and Village Clerk to sign the plat for and in the name of the Village. -3- 2. Approve the Performance Bond upon recommenda- tion of the Village Manager. 3. Deny the request for subdividing land and direct the Village Manager to so advise the petitioner. h. When Steps g-1 and g-2 are completed, the Final Plat shall be recorded in the office of the County Recorder by the Village Clerk and filed in the office of the Village Clerk. i. When Steps 9-1 and 9-2 are completed, the Village Manager may authorize construction to begin. SECTION 2: That Section 8.012, Approval of Subdivision of Small Tracts of Chapter 8, Subdivisions, be and the same is hereby amended to read as follows: 8.012 - Approval of One -Lot Subdivisions. When there is presented to the Village Board for approval a Plat of Subdivision or Re -Subdivision creating one lot, and if the Board after consideration thereof and recommendation thereon by the Village Engineer is of the opion that the intent and purpose of this chapter are not violated by such plat, and the construction of the improvements herein required cannot be reasonably enforced, the Board may waive the application or enforce the provisions of this chapter and approve such plat without requiring further procedure. SECTION 3: That Section 8.014, Enforcement) of Chapter 8, Subdivisions, be and the same is hereby amended to read as follows: 8.014 - Enforcement) The Village President and Board of Trustees of the Village hereby appoint the Village Manager as the enforcing officer of this Chapter and it shall be his duty to enforce the provisions hereof. The enforc- ing officer may call upon any department or official of the Village to furnish him with such information and assistance as he may deem necessary for the observance of enforcement of this chapter, and it shall be the duty of such department or official to furnish such information and assistance whenever required. SECTION 4: That any person, firm or corporation violating any provision of this Chapter shall be fined not less than $25.00 nor more than $500.00 for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. SECTION 5: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. SECTION 6: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
