AN ORDINANCE AMENDING SECTION 24.002, DISORDERLY
CONDUCT, OF THE MUNICIPAL CODE OF THE VILLAGE OF
ELK GROVE VILLAGE
WHEREAS, the Police Department of the Village of Elk Grove Village
has received numerous complaints concerning disorderly conduct, unlawful
congregation and vandalism occurring within the Village; and
WHEREAS, said unlawful activity is most prevalent in places of
public assemblage, including private property open to the public; and
WHEREAS, it has been requested both orally and in writing of the
Village by certain owners of said property that the Village enact and
enforce such ordinances as are reasonably necessary to abate disorderly
conduct, unlawful congregation, vandalism and the like; and
WHEREAS, such activity is deemed harmful to the welfare, safety
and general well-being of the residents of the Village and, therefore,
a nuisance.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Cook, and Du Page Counties,
as follows:
Section 1: That Section 24.002, Disorderly Conduct, of the Municipal
Code of the Village of Elk Grove be and the same is hereby amended to read
as follows:
24.002. Disorderly Conduct.
A. It shall be a.nuisance a.nd, therefore, unlawful for any
person to disturb the peace and quiet of the Elk Grove
Village or any portion thereof by disorderly conduct.
B. Disorderly conduct shall be committed by any person
when he knowingly:
1. Does any act in such unreasonable manner as
to provoke, make or aid in making a breach of peace;
2. Does or makes any unreasonable or offensive
act, utterance, gesture or display which, under the
circumstances, creates a clear and present danger of
a breach of peace or imminent threat of violence; or
3. Refuses or fails to cease and desist any
peaceful conduct or activity likely to produce a breach
of peace where there is an imminent threat of violence
and where the police have made all reasonable efforts to
protect the otherwise peaceful conduct and activity, and
have requested that said conduct and activity be stopped
and explain the request if there be time; or
4. Fails to obey a lawful order of dispersal
by a person known by him to be a peace officer under
circumstances where three or more persons are committing
acts of disorderly conduct in the immediate vicinity which
acts are likely to cause substantial harm or serious
inconvenience, annoyance or alarm; or
5. Assembles with three or more persons for the
purpose of using force or violence to disturb the public
peace; or
6. Appears in any public place manifestly under the
influence of alcohol, narcotics or other drugs, not
therapudically administered to the degree,
that he may endanger himself or other persons or property,
or annoy persons in his vicinity; or
7. Carries in a threatening or menacing manner,
without authority of law, any pistol, revolver, dagger,
razor, dangerous knife, stiletto, knuckles, sling shot,
an object containing noxious or deleterious liquid or
gas or substance or other dangerous weapon, or conceal
said weapon on or about the person or vehicles; or
8. Engages in fighting, threatening or tumultuous
behavior; or
9. Hinders, annoys, or molests persons passing along
any street, sidewalk, crosswalk, or other place which is
open to pedestrian traffic or where the public is invited to
enter; or
10. Loiters, sits, or stands around the entrance of
any church, theatre, public building, store, restaurant,
or other place of public assemblage, in any manner as to
so unreasonably obstruct such entrance; or
11. Disturbs, threatens, or in an insolent manner,
intentionally damages any house or vehicle.
C. A person convicted of disorderly conduct shall be fined not
less than $10.00 nor more than $500.00 for each offense.
Section 2: That if in the opinion of the Chief of Police, the posting
of signs, which state the prohibition of one or more of the above
activities is necessary, he shall cause the posting of said signs. If
these signs are to be placed on private property, the cost thereof shall be
borne by the owners of said property.
Section 3: Any person who violates any of the provisions of this
Ordinance shall be subject to a fine of not less than $10.00 nor more than
$500.00 for each offense.
Section 4: This Ordinance shall be in full force and effect from and
after its passage, approval and publication according to law.
