(J AN ORDINANCE GRANTING A USE VARIATION FOR THE MAIORIELLO FUNERAL HOME WHEREAS, the property owned by Mr. and Mrs. Maioriello and legally described on Exhibit 1 attached, which exhibit is incorporated by reference, is so shaped and located to make it undesirable for develop- ment with single family residences but uniquely suitable for a funeral parlor as proposed; and WHEREAS, if the owner were to be required to develop the property with single family .residences it would cause a practical hardship upon the owner and deprive the Village of a community facility which is needed; and WHEREAS, the funeral parlor use proposed is particularly compat- ible with the character of the neighborhood where it will be located; and WHEREAS, the particular plan set forth in Exhibit 2 attached accommodates the safe flow of traffic, the parking needs of the facility and is in keeping with the spirit and intent of the Comprehensive Plan of the Village; and WHEREAS, there has been a sufficiency of public hearings and no useful purpose would be served by additional hearings before boards and commissions of the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That the Zoning Ordinances of the Village of Elk Grove Village be and are hereby varied to the extent necessary to per- mit the construction of a funeral parlor on property legally described on Exhibit 1 attached, which exhibit is hereby incorporated by reference. That said funeral parlor shall be built in strict accordance with the site plan marked Exhibit 2, attached hereto and incorporated by reference, a copy of which site plan shall be maintained on file with the Village Clerk for public exhibit. That such variation shall continue in effect only so long as such use is made of the property. Non-use of the property for more than one year shall constitute abandonment and the use variation granted hereby shall, in such case, be deemed cancelled. Section 2: That except to the extent of the variation above mentioned, all other regulations of the R-3 Zoning Ordinance shall remain in full force and effect. Section 3: That any person, firm or corporation who violates_ provisions of the Zoning Ordinances and the regulations herein con- tained shall be required to pay a fine of not less than $10.00 nor more than $500.00 for each violation. Each day a, violation exists or continues to exist shall be deemed a separate offense. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
