HomeMy WebLinkAboutORDINANCE - 1034 - 1/13/1976 - RETAIL FOOD STORES/PRICINGORDINANCE NO. 1034 AN ORDINANCE PROVIDING FOR THE PRICING OF CERTAIN ITEMS SOLD IN RETAIL FOOD STORES LOCATED WITHIN THE VILLAGE OF ELK GROVE VILLAGE. WHEREAS, the Village of Elk Grove Village is a Home Rule Municipality as defined in the 1970 Illinois Constitution; and WHEREAS, certain retailers within the Village of Elk Grove Village have or are about to commence a practice of pricing of certain food products at retail by means other than the marking of said product or commodity; and WHEREAS, in order to protect the health, safety and welfare of the citizenry of the Village of Elk Grove Village and to prevent the under or over charging of any food product or commodity within the Village of Elk Grove Village and in order to facilitate the sale of said commodities and products and so that the citizenry of the Village of Elk Grove Village will at all times be aware of the price of the commodities which they intend to purchase, the President and Board of Trustees of the Village of Elk Grove Village deem it appro- priate and proper that an ordinance requiring the pricing of said commodities and merchandise be adopted. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois, as follows: Section 1: That Chapter 23, Miscellaneous Regulations, of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended by adding thereto a new article entitled 'Food Pricing' which shall read as follows: Article XV - Food Pricing Section 23.1501 - Applicability. This Article shall apply to all retail food stores situated and located within the Village of Elk Grove Village. Section 23.1502 - Pricing Required. Except as otherwise provided for herein it shall be unlawful for any person, firm or corporation to sell, or offer to sell, any item in a retail food store located within the Village of Elk Grove Village unless the item contains a price marked thereon in arabic numerals which can be easily read by the consumer purchaser. Section 23.1503 - The following items arae excluded from the price marking requirement contained in Section 23.1502 above, to -wit: A. Identical items with a multi -pack package which is properly price marked. B. Single cigars and single packages o'[ cigarettes. C. Candy, gum and other confectionary items selling for fifteen (154) cents or less pa.r =item. Section 23.1504 - Any person, firm or corporation who violates any of the provisions of this Article shall be subject to a fine of: not less thin $25.00 nor_ more tha:i $500.00 for each offense. Each day that such a violation is permitted to continue to exist shall constitute a distinct and separate offense. Section 2: Any person, firm or corporation who violates any of the provisions of this Article shall be subject to a fine of not less than $25.00 nor more than $500.00 for each offense. Each day that such a violation is permitted to continue to exist shall constitute a dis- tinct and separate offense. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTE: AYES 6 NAYS PASSED this 13th day of.
