HomeMy WebLinkAboutORDINANCE - 1042 - 2/24/1976 - FIRE LANES/VLG ON THE LAKEORDINANCE NO.l� AN ORDINANCE AMENDING SECTION 23.903 (LANE DESIGNATION) OF ARTICLE IX (FIRE LANES) OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS the Village on the Lake Homeowners Association has adopted a resolution, pursuant to Section 11.209.1, Chapter 95;, of the Illinois Revised Statutes, 1975, requesting the Village of Elk Grove Village, its police and fire depart- ments, to regulate all vehicular traffic on any private road- way, trail, terrace, parkway or parking area within property which it owns and controls (which resolution is attached as Exhibit A); and, WHEREAS that Association has submitted a map of property owned and controlled by them (which map is attached as Exhibit B) depicting red areas requested to be designated as fire lanes; and, WHEREAS the chief of the fire department has concurred in the request by the Association: NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, as follows: SECTION 1: That Section 23.903 of the Municipal Code of the Village of Elk Grove Village, which provides for certain areas located in the Village to be designated "Fire Lanes", and making it unlawful for any person or vehicle to block or obstruct wholly or partially any such designated area, be amended by adding thereto the following: K. The Village on the Lake Condominiums - All areas designated as Fire Lanes on a map entitled ,Village on the Lake Homeowners Association", which map is incorporated by reference as a part of Ordinance No. SECTION 2: That a map entitled,"VILLAGE ON THE LAKE HOMEOWNERS ASSOCIATION"' with red markings indicating thosaareas designated as fire lanes (Exhibit B, attached hereto) be and the same is hereby incorporated into this ordinance. SECTION 3: Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Five ($5.00) Dollars, nor more than Two Hundred ($200.00) for each offense. SECTION 4: That this ordinance shall be in full force and effect from and after its passage approval and publication according to law. SECTION 5: That the Village Clerk is hereby authorized to publish this ordinance in pamphlet form and the Village Manager is directed to post all areas designated as fire lanes hereby with appropriate signs. VILLAGE ON THE LAKE HOMEOWNERS ASSOCIATION INFORMAL ACTION AND CONSENT OF DIRECTORS 'The undersigned, being all the directors of VILLAGE ON THE -LAKE HOMEOWNERS ASSOCIATION, do hereby unanimously consent to the adoption of the following resolutions: RESOLVED that the VILLAGE ON THE LAKE HOMEOWNERS ASSOCIATION, pursuant to Section 11.209.1, Chapter 953, Motor Vehicles of Illinois Revised Statues, do hereby request the Village of Elk Grove Village, its Police and Fire Departments, to regulate all vehicular traffic on any private.roadway, trail, terrace, parkway or parking area in that part of the following described property which it owns and controls: That area bounded on the north by Cosman Road between Bisner Road on the west and the lot line perpendicular to the west end of Walter Street on the east. And, by the north lot line of the properties facing Burgundy Court between the lot line perpendicular to the west end of Walter Street and Chelmsford Lane. Bounded on the east by Chelmsford Lane between Wellington Avenue and Stonehaven and the east boundary of properties facing Wellington Avenue between Chelmsford Lane and Biesterfield Road. Bounded on the south by Biesterfield Road between Wellington Avenue and Leicester Road, and by Gloucester Drive between Leicester Road and Eisner Road. Bounded on the west by Leicester Road between Biesterfield Road and Gloucester Drive, and by Eisner Road between Gloucester Drive and Cosman Road. RESOLVED that the VILLAGE ON THE LAKE HOMEOWNERS ASSOCIATION does hereby determine that any person in any common area, private roadway, trail, terrace, parkway or parking area who is not a member or an invitee of any of the following Associations: The Elk Grove Estates Custom Lots Association The Elk Grove Estates Townhome Condominium Parcel C Association The Elk Grove Estates Townhome Condominium Parcel E Association The Elk Grove Estates Homeowners Association The Elk Grove Estates Townhouse Association II Elk Grove Estates Village on the Lake Association is hereby declared a trespasser if found in any area described as follows: That area bounded on the north by Cosman Road between Bisner Road on the west and the lot line perpendicular to the west end of Walter Street on the east. And, by the north lot line of the properties facing Burgundy Court between the lot line, perpendicular to the west end of Walter Street and Chelmsford Lane. Bounded on the east by Chelmsford Lane between Wellington Avenue and Stonehaven and the east boundary of properties facing Wellington Avenue between Chelmsford Lane and Biesterfield Road. Bounded on the south by Biesterfield Road between Wellington Avenue and Leicester Road, and by Gloucester Drive between Leicester Road and Bisner Road. Bounded on the west by Leicester Road between Biesterfield Road and Gloucester Drive, and by Bisner Road between Gloucester Drive and Cosman Road. And the Ass ition officers are hereby zthorized and directed to file a trespass complaint against said persons upon being notified of their trespass by the Elk Grove Police Department or otherwise. That the VILLAGE ON THE LAKE HOMEOWNERS ASSOCIATION does further direct the Police Department of Elk Grove Village to take any and all action which it deems necessary to eliminate trespass in the heretofore described area.
