HomeMy WebLinkAboutORDINANCE - 903 - 1/2/1974 - CENTEX CONSTRUCTIONORDINANCE NO, /O.J AN ORDINANCE GRANTING VARIATIONS DUE TO BUILDER ERROR WHEREAS, due to an error of the builder, Centex Ccnstruc- tion Company, the hereinafter described properties were built upon contrary to the side yard provisions of the Zoning Ordinance of the Village of Elk Grove Village; and, WHEREAS, to correct the aforementioned buildings to con- form same to the Zoning Ordinance would require demolition or structural alteration to said buildings and would lead to unreason- able and severe hardship upon the owners who were innocent of fault; and, WHEREAS, it is deemed to the best interests of the Village by its corporate authorities that owners of said property not be penalized by requiring them to seek individual variations; and, WHEREAS, since the date of the public notice before the Zoning Board of Appeals, a comprehensive amendment to the Zoning Ordinance has been adopted permitting a 12" (one foot) over- hang of the eaves of any building into side or front yards, which amendmen+- reduces the necessary variations to place the hereinafter described property in conformance with the Zoning Ordinance of the Village of Elk Grove Village. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Couni:ies of Cook and DuPage, as follows: Section 1: That the Zoning Ordinance of the Village of Elk Grove Village, as amended to date hereof, be further varied so as to permit existing structures insofar as -they are presently constructed to intrude into their front and side yards as specified in Exhibit A, attached, which exhibit is incorporated herein by reference. Section 2: That any person, firm or corporation who violates, disregards or disobeys this ordinance shall be subject to a fine of not more $200.00, nor less than $25.00 for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 3: That the Village Clerk is authorized and directed to send a copy of this ordinance to the owner and/or occupant of the buildings located on the property described in Exhibit A attached. Section 4: That the Village Clerk is authorized and directed to publish this ordinance in pamphlet form. Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publication, ac- cording to law. r_l PASSED this ."'day of *-1974. APPROVED this day of 1974.
