HomeMy WebLinkAboutORDINANCE - 853 - 5/29/1973 - ZONING ORDINANCE AMENDEDORDINANCE NO. j 2 AN ORDINANCE AMENDING THE ELK GROVE VILLAGE ZONING ORDINANCE BY AMENDING AND ADDING CERTAIN DEFINITIONS, WHEREAS, the Plan Commission of the Village of Elk Grove Village, sitting as a Zoning Commission, at a public meeting duly called and held according to law, considered the question of amending and adding certain definitions of and to the Elk Grove r' Village Zoning Ordinance, and has submitted its recommendations r" on said question to the President and Board of Trustees of the Village of Elk Grove Village; and r WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage have considered the recommendation of said Zoning Commission and have determined that said amendments are i}ecessary and proper; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Groye Village, Counties of Cook and DuPage, Illinois,"as follows: Section 1: /That Section 9e12^of Article 9, Definitions, of an ordinance entitled, "AN ORDINANCE TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILDINGS, TO REU`U f I INTENSITY AND USE OF LOT AREAS, AND REGUL, OF OPEN SPACE'WITHIN AND SURROUNDING SUCH TE AND LIMIT THE AND DETERMINE AREAS TO CLASSIFY, REGULATE AND RESTRICT THE LOCATION OF TRADES:, OF INDUSTRIES, AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED INDUSTRIAL, BUSINESS, RESIDENTIAL AND OTHER USES; TO DIVIPDE THE ENTIRE VILLAGE OF ELK GROVE VILLAGE INTO DISTRICTS FOR THE PURPOSE OF THIS ORDINANCE, TO FIX STANDARDS TO WHICH BUILDINGS OR STRUCTURES SHALL CONFORM; TO PROHIBIT USES, BUI/L/DINGS OR STRUCTURES INCOMPATIBLE c ORDINANCE NO. j 2 AN ORDINANCE AMENDING THE ELK GROVE VILLAGE ZONING ORDINANCE BY AMENDING AND ADDING CERTAIN DEFINITIONS, WHEREAS, the Plan Commission of the Village of Elk Grove Village, sitting as a Zoning Commission, at a public meeting duly called and held according to law, considered the question of amending and adding certain definitions of and to the Elk Grove r' Village Zoning Ordinance, and has submitted its recommendations r" on said question to the President and Board of Trustees of the Village of Elk Grove Village; and r WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage have considered the recommendation of said Zoning Commission and have determined that said amendments are i}ecessary and proper; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Groye Village, Counties of Cook and DuPage, Illinois,"as follows: Section 1: /That Section 9e12^of Article 9, Definitions, of an ordinance entitled, "AN ORDINANCE TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILDINGS, TO REU`U f I INTENSITY AND USE OF LOT AREAS, AND REGUL, OF OPEN SPACE'WITHIN AND SURROUNDING SUCH TE AND LIMIT THE AND DETERMINE AREAS TO CLASSIFY, REGULATE AND RESTRICT THE LOCATION OF TRADES:, OF INDUSTRIES, AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED INDUSTRIAL, BUSINESS, RESIDENTIAL AND OTHER USES; TO DIVIPDE THE ENTIRE VILLAGE OF ELK GROVE VILLAGE INTO DISTRICTS FOR THE PURPOSE OF THIS ORDINANCE, TO FIX STANDARDS TO WHICH BUILDINGS OR STRUCTURES SHALL CONFORM; TO PROHIBIT USES, BUI/L/DINGS OR STRUCTURES INCOMPATIBLE WITH THE CHARACTER OF SUCH DISTRICTS, RESPECTIVELY, AND TO PREVENT ADDITIONS TO AND ALTERATIONS OR REMODELING OF EXISTING BUILDINGS OR STRUCTURES IN SUCH A WAY AS TO AVOID THE RESTRICTIONS AND LIMITATIONS LAWFULLY IMPOSED HEREUNDER, AND TO PROVIDE PENALTIES FOR VIOLATIONS HEREOF, passed and approved duly 8, 1957, known as Ordinance No. 20, as amended, be further amended so that the definition "Common Open Space" shall read as follows, and that an additional definition, "Senior Citizen Housing," which reads as follows shall be added thereto; COMMON OPEN SPACE Land unoccupied by structures, buildings, streets, rights of way, and automobile parking lots, and designed and intended for the use or enjoyment of residents of a planned development. Except for Senior Citizen Housing, no area within 30 feet of any building or structure, except structures used for recreational use, shall be includable for Common Open Space. SENIOR CITIZEN HOUSING Shall be housing designed for and used by a family unit wherein the head of the household is 60 years of age or older, and which housing is two stories or less in height. Section 2: That this ordinance shall be in full force and effect from an d after its passage, approval and publication, according to law. PASSED this 29th day of May , 1973.
