AN ORDINANCE APPROVING THE PRELIMINARY SITE
PLAN FOR PROPERTY SUBJECT TO A-2 ZONING FOR
THE DEVELOPMENT OF SENIOR CITIZEN HOUSING, AND
GRANVING A SPECIAL USE PERMIT SUBJECT TO A
PARKING PLAN AGREEMENT FOR SAID PROPERTY
WHEREAS, the Plan Commission of the Village of Elk Grove
Village has conducted a public hearing duly called and held
according to law to review a preliminary site plan for property
to be developed pursuant to A-2 Special Use Planned Development
Zoning for the development of senior citizen housing, and has
submitted its recommendations on such plan to the President and
Board of Trustees; and
WHEREAS, the President and Board of Trustees, having review-
ed said recommendations find and believe that the granting of a
special use permit subject to a parking plan agreement is in the
best interests of the village.
NOW, THEREFORE, BE IT ORDAINED, by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That the Preliminary Site Plan for property
legally described on the attached Exhibit A, which Plan was pre-
pared by Holabird and Root, Architects, is specified as Project
#11179, dated March 22, 1973 and rev.i_sed May 8, 1973 and May 29,
1973, be and is hereby approved.
Section 2: That there is hereby granted to the property
legally described on the attached Exhibit A a special use permit
wbe reby said property sha11 be developed and occupied as a planned
development for senior citizen housing pursuant to the Preliminary
Site Plan approved herein and pursuant to the Parking Plan Agreement
attached heretc, as Exhibit B.
Section 3: That this ordinance shall be in full force and
effect from and after.its passage, approval and publication,
according to law.

The South West quarter of the North East quarter of Section 32 (except the
East 419.0 feet as measured along the North line of the South 80.0 feet of
the North 1250.0 feet, as measured along the East line; and except the East
810.0 feet; as measured along said North line, of the North 1170.0 feet, as
measured along said East line; and except that part of the North 931.83 feet,
as measured along the West line, of said South West quarter of the Northeast
quarter, lying West of the West of the aforementioned East 810.0 feet of said
quarter quarter section; and excepting also that part of the East 45.0 feet,
as measured at right angles, of said South West quarter of the North East

PARKING PLAN AGREEMENT
WHEREAS, the undersigned, as owner or contract purchaser of
fee ownership in property legally described on the attached
Exhibit A has submitted its application to the Village of Elk
Grove Village for said property a special use zoning to allow
same to be developed for a Planned Development for Senior Citizens
Housing, pursuant to a preliminary site plan; and
WHEREAS, the Plan Commission of the Village has determined
that an agreement providing for a parking plan be established as a
condition of recommending to the President and Board of Trustees
of the Village the approval of said preliminary site plan; and
NOW, THEREFORE, BE IT AGREED by the undersigned, as owner
or contract purchaser (hereinafter referred to as "owner") of
fee ownership of property legally described on the attached
Exhibit A, and the Village of. Elk Grove Village (hereafter
referred to as "Village"), as follows:
1. That this Agreement be and is hereby made part of the
application to allow the property legally described on the attached
Exhibit A to be zoned A-2, Special Use Planned Development
for Senior Citizen Housing.
2. That owner will originally provide 0.8 parking spaces
for each dwelling unit constructed on the property subject to
the special use.
3. When required by the Village, as evidenced by certified
mail service from the President and Board of Trustees that it
determines additional parking spaces to be needed, owner shall
promptly commence to provide additional parking spaces, and sla ll
diligently prosecute the construction and preparation thereof
as follows: Owner, in owner's sole discretion, shall either
remove islands and green spaces in and around the original packing
spaces, or Owner shall provide a deck for parking over one or
more of the original parking areas. In no event shall Owner be
required to provide more than two parking spaces for each dwelling
unit constructed on the property subject to the special use.
4. In the event Owner fails to comply with the terms
of this parking plan, the Village may prohibit the
occupancy of any such dwelling units from time to time
becoming vacant, in order to achieve the ratio of parking
spaces to dwelling units (not to exceed two parking spaces
per dwelling unit), determined to be necessary by the
Village President and Board of Trustees.
5. That the provisions of this Agreement shall be en-
forceable against those persons and their successors in title
who are the record title holders of the property, or portion
thereof, at such time as the Village President and Board of
Trustees forwards the notice required in Paragraph 3 hereof.
6. That this Agreement shall be binding upon the parties
hereto, and their successors or assigns of title to the property
