HomeMy WebLinkAboutORDINANCE - 847 - 3/6/1973 - SPECIAL USE/550 BENNETTI ORDINANCE NO. 847 AN ORDINANCE RELATING TO THE RELIABLE SHEET METAL COMPANY AT 550 BENNETT ROM, AND APPROVING A SPECIAL (PARKING) LOCATION PLAN PURSUANT TO SECTION 3.93 OF THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the American National Bank and Trust Company of Chicago, as Trustee under Trust No. 24464, is the record title owner of the premises described as Parcel 1 and Parcel 2, legal descriptions of which are attached hereto and incorporated by reference herein; and WHEREAS, said record owner and beneficiaries of said trust desire to add to an existing building to be located on. Parcel 1 in such manner as to make compliance with the Zoning Ordinance of the Village of Elk Grove Village relating to parking impossible due to the extent of the building coverage, and WHEREAS, to satisfy the parking requirements of the.Village and to permit the building addition referred to above, the record owner has acquired Parcel 2, which it desires to be treated together with Parcel 1 as one parcel of property so as to comply with zoning and land use requirements of the Village. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, as follows: Section 1: That the real estate described as Parcel I and Parcel 2, legal descriptions of which are attached hereto and in- corporated herein, be and are hereby treated henceforth as one parcel of property so as to satisfy the land use and zoning requirements of the Village relative to parking. Section 2: That the record owner shall cause an agreement and plat of subdivision marked Exhibit B and C to this ordinance, copies of which are on file with the Village Clerk and have been duly recorded with the Recorder of Deeds of Cook County, Illinois, to be executed to further the purposes of this ordinance. - I - Section 3: That the President and Board of Trustees do approve a parking plan, the detail of which is to be submitted by the record owner for the above described premises provided said plan shall: A. Mmyide a minimum of 45 parking spaces on Parcel 2, each space_ to be not less than 10' x 20'. and having an access to an aisleway for ingress and egress, and maintain 8 parking spaces on Parml 1. 2. Provide parking on Parcel 2 solely for operable motor passenger vehicles owned and/or leased by the business firm located at 550 Bennett Street, Elk Grove Village, or its employees. No trmcks, trailers or tractors shall be parked or stored thereon. 3. The parking area shall be improved as per plan designated below as a condition to use. Plan for the parking lot area shall include: (a) Adequate provision for underground storm water drainage system approved by the Village Engineer; (b) Provided with a concrete or asphalt surface; (c) A concrete apron be placed upon public property in the manner approved by the Village Engineer; (d) A concrete sidewalk be placed on public property to afford proper pedestrian traffic; (e) Wheel stops be provided for each parking space; (f) Low intensity, non -glare lighting be placed upon the lot as approved by the Village Engineer; (g) No parking shall be permitted on any easement or within 25' of the front yard line. Landscaping with pervious material shall be made to the public property in front of Parcel 2. 4. Parcel 2 is to be used exclusively for parking in the manner provided and is not to be built upon with buildings or structures other than 'fencing. Se ction 4: That for the purpose of instrumenting the Elk Grove Village zoning ordinance, the record owners have executed an - 2 - Agreement and provision on a plat, copies of which are marked Exhibits B and C to this ordinance and filed with the Village Clerk and have been duly recorded with the Recorder of Deeds of .Cook County, Illinois. Section 5: That the Village Clerk is hereby directed to record a copy of this ordinance with the Recorder of Deeds, Cook County, Illinois and to cause the zoning map of the Village to be appropriately noted. Section 6: That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of any of the provisions of this ordinarc a shall be sub- ject to a fine of nor less than $5.00, nor more than $500.00 for each offense, and each day a violation continues to exist shall con- stitute a separate offense. Section 7: That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this 6th day of March , 1973.
