HomeMy WebLinkAboutORDINANCE - 781 - 2/22/1972 - REMOVAL OF ABANDONED VEHICLESZ)y ORDINANCE NO, i AN ORDINANCE AMENDING CHAPTER 14 OF THE MUNICIPAL CODE, BY ADDING A NEW SECTION PROVIDING FOR THE REMOVAL OF ABANDONED VEHICLES WHEREAS, a continually increasing number of motor vehicles are being abandoned upon the streets and vacant private property within the Village of Elk Grove Village; and WHEREAS, such abandonment of motor velicles creates a problem insofar as the health, safety and welfare of the citizens of the Village of Elk Grove Village; and WHEREAS, the "Illinois Vehicle Code" grants to the corporate authorities of each municipality the power to provide for the removal of abandoned motor vehicles; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, that a new section, entitled, "Abandoned Vehicles" be added to Chapter 14 of the Municipal Code, said section to read as follows: Section 1: 14.1101 (Abandoned Vehicles) (a) It shall be unlawful for a person to abandon a vehicle upon or adjacent to any roadway within the Village of Elk Grove Village, Illinois. (b) It shall be unlawful for a person to abandon a vehicle upon any public or private property without the express or implied consent of the owner or person in lawful possession or control of the property. (c) It shall be unlawful for a person to permit a motor vehicle to remain in any stationary posi- tion in an unoperational condition as to create a hazard to health or personal injury. 14.1102. (Removal.) Any police officer who has reasonable grounds to believe that a vehicle has been abandoned may remove that vehicle or cause it to be moved, at the expense of the owner, to the nearest garage or otherplace of safety, and immediately send a written notice to said owner. 14.1103. (Disposition.) In the event a vehicle is not reclaimed by the registered owner or any lienholder within 30 days, the laws of this state governing the disposition of abandoned property, Chapter 952, Section 4.200-4.213, Illinois Revised Statutes, 7' 1969, shall apply. 14.1104. For purposes of this section, a vehicle shall be presumed to be abandoned if it is left unattended on any roadway or adjacent area thereto for a period in excess of 3 days or on any public or private property without express or implied consent of the owner or person in lawful possession or control of the property for a period in excess of 7 days. 14.1105. (Penalty.) Any person, firm or corporation convicted of abandoning an auto upon the roadway or any area within the Village of Elk Grove Village which would. therefore constitute a hazard shall be fined not less than $5.00, nor more than $500.00 for each offense.
