(n4Z AN ORDINANCE AMENDING VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE AUTHORIZING A SPECIAL USE PERMIT TO INSTALL THREE (3) RADIO ANTENNA TOWERS ON PROPERTY AT THE ELK GROVE HIGH SCHOOL WHEREAS, the Board of Education of School District 214 is the owner of certain properties in the Village of Elk Grove Village, upon which there is constructed a public high school known as Elk Grove High School, and WHEREAS, the Elk Grove Village Amateur Radio Club has entered into an agreement with said Elk Grove High School and School District, to cause the installation of three (3) radio and TV antenna towers, which agreement is dated July 22, 1968 and attached hereto as Exhibit A. and WHEREAS, the relationship of the foregoing parties is that of lessor and lessee, and WHEREAS, it is necessary and to the best interest of the Village that a special use permit be granted as applied for. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois: Section 1: That the zoning ordinance of the Village of Elk Grove Village be amended and modified to permit the construction and installation of three (3) radio and TV antenna towers on premises known as the Elk Grove High School, in the Village of Elk Grove Village, said towers to be of a height not to exceed thirty five (35) feet from ground level, to be in accordance with the conditions set forth in Exhibit A attached and to exist only so long as the, Board of Education of School District 214 shall permit and consent to their being so constructed and maintained. Section 2: That any person, firm or corporation, who -1- violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred ($200.00) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 3: This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED this 18th APPROVED this 18th ATTEST: Eleanor G.
