HomeMy WebLinkAboutORDINANCE - 527 - 4/9/1968 - DEPOSITS FOR STRET EXCAVATIONSORDINANCE NO.- 427 AN ORDINANCE AMENDING SECTION 11.306 OF THE MUNICIPAL CODE RELATING TO DEPOSITS FOR STREET EXCAVATIONS NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section,l. That Section 11.306 of the Municipal Code of Elk Grove Village be and is hereby amended to read as follows: "11.306 Deposit.) No such permit except as provided herein shall be issued unless and until the applicant therefor has deposited with the Clerk a cash deposit in the sum of $200.00, if no pavement is involved, and $500.00 if the excavation is in a paved area, to insure the proper restoration of the ground and laying of the pavement, if any. In the event any contractor shall have several jobs in process and shall have cash deposits of $1,000 he shall not be required to make additional deposits for any additional jobs and a special escrow arrangement shall be made making available all deposits for all jobs in process. From this deposit shall be deducted the expense to the Village of relaying the surface of the ground or pavement and of making the refill if this is done by the Village or at its expense, and the balance shall be returned to the applicant without interest after the tunnel or excavation is completely refilled and the surface or pavement is restored. Companies acting as the Village's agent and public utilities franchised by the Village shall not be required. to make the cash deposits called for herein." Section 2. That this ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 9th day of Apra 1968. APPROVED this 9th day of April , 1968. Jack D.
