O AN ORDINANCE AMENDING CHAPTER VI OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE RELATING TO THE FIRE DEPARTMENT AND FIRE PREVENTION CODE* NOW, THEREFORE BE IT (RDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois: Section 1. That Chapter VI of the Municipal Code of the VU3A`ge o rove Village be and is hereby amended to read as follows: ° CHAPTER VI FIRE DEPARTMENTS AND CODE ARTICLE I - FIRE DEPARTMENT .6 .,10011 Establishment.) There is hereby created and established a Department of the Municipal Government of the Village of Elk Grove Village which shall be known as the Fire Department. Said Depart- ment shall consist of: A Fire Chief Three (3) Lieutenants Six (6) full-time Firemen. 6.102 Members of Department.) The Fire Chief shall be appointed B=70 Village President with the advise and consent of the Board of Trustees; other members of the Fire Department shall be appointed by the Board of Fire and Police Commissioners of the Village of Elk Grove Village in accordance with the Statute. 6.103 Control of Department.) All Members of the Fire Department sa perform such duties as may be required of them by said Fire Chief and the Ordinances of the Village. 6.104 Management.) The Fire Chief shall have sole and exclusive control and management of all matters and things pertaining to the Fire Department, and all officers and employees therein engaged. 6.105 Oath and Bond.) The Fire Chief, before entering on the duties of his office shall take the oath of office prescribed by Statute. 6.106 Regulation of Members of Department.) All officers and emp ogees of the Fire Department shall be subject to such Rules and Regulations, and perform such duties, as shall be prescribed or required of them by said Fire Chief or the Ordinances of the Village. 6.107 Oath and Bond of Other Members.) All other members of the Fire r5FFrtment appointed by the Board of Fire and Police Commissioners, before entering upon the duties of their office, shall take the oath of office prescribed by Statute. 6.108 Annual Estimate.) On or before the first day of March of each year, the Fire Chief shall prepare and submit to the Village Manager an estimate of the total cost and expense of providing for and maintaining the Fire Department of the Village during the ensuing fiscal year, which estimate shall be in the form required by the Village Manager. 6.109 Report of Acoiderta.) On or before May 1 of each year, the 7 a Chief shall prepare and submit to the President and Board of Trustees a report of all acoidents by fire that may have taken place in the Village during the preceding fiscal year, the causes of same, a description of all buildings deertrayed, as well as a report as to persons injured or killed. 6.1.0 Investigation of Fires.) The Fire Chief shall inquire into, nnvetigate causes of all fires in the Village,as soon after their occurrence as practical, and he shall keep a record of such investi- gation and the evidence adduced thereby. 6.111 Records.) The Fire Chief shall keep a full and complete record of all transactions of the Department, of all property in his charge, as well as such records as shall be required to conduct the business of the Department. 6.112 Inspection of Apparatus.) The Fire Chief shall, once each mi=n, examine all fire engines, apparatus and the fire house, and report the condition of same to the President and Board of Trustees on or before May 1 of each year. 6.113 Rules and Regulations.) All officers and employees of said repartment shall be subject to such Rules and Regulations adopted by the President and Board of Trustees pertaining to the operation of said Fire Department and the Rules and Regulations of the Board of Fire and Police Commissioners of the Village of Elk Grove Village. Each member of the Department shall be furnished with copies of said Rules and Regulations. Any member of the Fire Department, other than the Fire Chief, shall be subject to discharge or disciplinary action by the Board of Fire and Police Commissioners or subject to suspen- sion for a period of not to exceed five (5) days by the Fire Chief, in accordance with the provisions of the Act pertaining to Boards of Fire and Police Commissioners of the State of Illinois. 6.114 Uniform.) Each member of the Fire Department is required to wear a uniform in accordance with regulations promulgated by the Fire Chief and a badge to be furnished by the Village by which, in case of fire, and at other times, the relations of such members of the Fire Department may be known, as the exigencies of their duties may require. 6.115 Hours of Duty.) The Fire Chief shall arrange the working hours o�tie members of the Department so that no officer or employee shall be required to be on duty more than 24 hours in any consecutive 46 hour period; providing, however, that the Fire Chief, acting in his official capacity, may in case of serious conflageration, riot or other dire emergency, require such members of the Department to be on duty or to continue on duty during the period of such emergency. 6.116 Merit Roll.) It shall be the duty of the Fire Chief to cause a record to be kept, to be known as the "Merit Roll" upon which shall be entered the names of all members of the Fire Department who shall have performed any distinguished actions of bravery in the performance of duty. Such record shall specify the details and circumstances of such actions, and there shall also be given the names of witnesses, if any, and all facts corroborating the circum- stances of the report. Such record shall annually, on the first day of each year, be submitted to the President and Board of Trustees of the Village for such acts of commendation as the President and Board of Trustees may seek to bestow upon such member or members of the Fire Department, -2- 6.117 Efficiency Reports.) The Fire Chief shall establish and main"�ain a system for ascertaining and recording the individual. efficiency of each officer and employee of the Fire Department. The efficiency reports of such members shall be submitted to the Board of Fire and Police Commissioners each three (3) months beginning with the first day of May of each year. 6.119 Removal of Property.) The Fire Chief shall have the power to cause the removal of any property, whenever it shall become necessary for the preservation of such property from fire or to prevent the spreading of fire or to protect adjoining property. 6.119 Destruction of Buildings.) The Fire Chief or other officer in command, may direct the firemen to out down and remove any building, erection or fence, for the purpose of checking the progress of any fire; and the Fire Chief, or other officer in command shall have power to blow up or cause to be blown up, with any explosive, any building or erection during the progress of a fire for the purpose of extinguishing or checking same. 6.120 Power of Arrest.) The Fire Chief or any Lieutenant of the Fire Department shall have the power, during a fire, and for a period of 36 hours after its extinction to arrest any person sus- pected of incendiarism, or any person hindering, resisting or delaying the firemen or conducting himself in a noisy or disorderly manner, or refusing to obey such officer while acting in the dis- charge of his duty. Said Officers be and they are hereby severally vested with the usual powers and authority of police officers to command all persons to assist them in making any necessary arrests. 6.121 Absence or Inability of Fire Chief.) During the absence or inability of the Fire Chief to act, the next senior officer or member of the Department or such member of the Department as may be designated in writing by the Fire Chief shall perform the duties of the Fire Chief. -3- ARTICLE II PAID ON CALL DEPARTMENT 6.201 Establishment.) There is hereby created and established s Paid On Call Fire Department. 6.202 Supervision over Departments.) The Paid On Call. Fire 7epartment shall be under the control of the Fire Chief or next senior officer, or such other member of the regular Fire Department who shall serve during the absence or inability of the Fire Chief to act as provided for in the ordinance establishing a Fire Depart- ment in and for said Village. 6.203 Command at Fires.) In case of fire, the Fire Chief and his a a -tants shall rank in the order named and the officer of the highest rank at the fire shall take command of both the regular Fire Department and the Paid On Call Fire Department, and direct the management thereof for the suppression of the fire, in the best manner possible, and all Paid On Call firemen shall be subject to the orders of such officers of the regular Fire Department and subject to the rules and regulations of the Fire Department as adopted by the Village President and Board of Trustees pertaining to the operations of said Fire Department. 6.204 Membership and Organization.) The Paid On Call Fire Depart - men —shall consist of so many members as may be decided upon by the President and Board of Trustees and selected by the Village Manager. The Fire Chief shall keep or cause to be kept a record and shall make a report to the President and Board of Trustees of all meetings and all activities of the Paid On Call Fire Department, No officer shall be appointed without the approval of the Village President and Board of Trustees. 6.205 Records.) The Fire Chief shall keep or cause to be kept a record of all meetings of the company and the attendance of the members, a record of all fires, and during the last week of April of each year, file with the Village Clerk, a full report of such records and attendance and fires, which report shall be under oath. 6.206 Duties.) It shell be the function and duty of the Paid On 7,a Fire Department and every member thereof to cooperate with the regular fire department of the Village to extinguish accidental or destructive fires. 6.207 Obedience to orders.) Any Paid On Call Fireman in attendance aY a fire who shall neglect or refuse to obey the orders of the officer in command at such fire shall be subject to such disciplinary action as may be imposed by the Village Manager and in accordance with the Personnel Rules and Regulations of the Village currently in force. 6.208 -Removal.) Any Paid On Call Fireman shall be removed by the V age Manager in accordance with the Personnel Rules and Regula- tions of the Village currently in force. -4- ARTICLE III FIRE PREVENTION CODE 6.301 Adoption of Fire Prevention Code.) The Fire Prevention o e, other than the provisions thereof relating to fees for licenses and permits and relating to penalties recommended by the National Board of Fire Underwriters, 1960 hdition, and subse- quent amendments thereto, adopted prior to the adoption of this Code, is hereby adopted as the Fire Prevention Code of the Village and is hereby made a part of this Code. Three copies of such Fire Prevention Code and amendments thereto have for more than the past fifteen days been, now are, and hereafter shall be kept on file in the office of the Village Clerk. Where any provisions of such Fire Prevention Code are in conflict with the state law, the provisions of this Code or other ordinances of the Village, the State law, the provisions of this Code and such Village ordinances shall prevail. 6.302 Establishment and Duties of Bureau of Fire Prevention.) A. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the Village of Elk Grove Village which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. B. The Fire Chief shall be Chief of the Bureau of Fire Pre- vention, which Bureau shall consist of the Fire Chief, Superintendent of Building, and three other members to be appointed by the Chief of the Bureau. C. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department may recommend to the corporate authorities of the Village of Elk Grove Village the employment of technical inspectors. 6.303 Definitions.) Wherever the word "Municipality" is used in TF a Fire Prevention Code, it shall be held to mean the Village of Elk Grove Village. 6.304 Prohibition of Storage and Location of Certain Matter.) A. Storage of flammable liquids in outside aboveground tanks referred to in Section 16.22a of the Fire Prevention Code is hereby prohibited. B. New bulk plants for flammable liquids referred to in Section 16.51 of the Fire Prevention Code are hereby prohibited. C. Bulk storage of Liquified petroleum gas referred to in Section 21.6a of the Fire Prevention Code is hereby prohibited. D. Storage of explosives and blasting agents referred to in Section 12.6b of the Fire Prevention Code is hereby prohibited. 6.305 Modifications.) The Bureau of Fire Prevention shall have power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Bureau of Fire -5- Prevention shall be entered upon the records of the department and a signed copy shall be furnished the applicant. 6.306 New Materials or Processes which may Require Permits.) The '7 age President, the Chief of the Fire Department and the Bureau of Fire Prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in said code. The Chief of the Fire Department shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons. 6.307 Appeals.) Whenever the Chief of the Fire Department shall. 3Tapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the probisions of the code do not apply or that the true intent and the meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within 30 days from the date of the decision of the appeal. Thereupon the said President and Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent information. The decision of the President and Trustees shall be final. 6.308 Permits.) It shall be unlawful to construct, install or enlarge any tank, pump or piping equipment for the storage or handling of flammable or volatile liquid such as defined in this article without having first obtained a permit therefor. Application for such permits shall be made to the Village Clerk, and shall be accompanied by a drawing to scale showing the location as well as plans showing the type and nature of installation or alteration. 6.309 Approval.) No such permit shall be issued until the Building Inspector has certified that the contemplated work fully complies with the ordinances of the Village. For installation of fuel oil tanks having a capacity of more than two thousand gallons and less than 20,000 gallons - $75.00. For installation of tanks for storage of gasoline having a capacity of less than 10,000 gallons - $75.00. For installation of fuel oil tanks having a capacity of 20,000 gallons or more - 075.00. For installation of gasoline storage tanks having a capacity of 1,000 or over - 075.00. For installation of tanks for other flammable liquids - $75.00. 6.310 Licenses.) It shall be unlawful for any person, firm, or corporation to sell or deal in flammable liquids, gasses and solids, Including the sale of paints but excluding automobile service stations without having first obtained a license therefor. The annual fee for said license shall be $30.00. 6.311 Penalties.) A. Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made there- under, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder -6- and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Chief of the Fire Prevention Bureau or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less than $10.00 nor more than $200.00 or by imprisonment for not less than ten (10) days nor more than six (6) months, or by both such fine and imprisonment. The imposition of one penalty for any and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense. B. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions." Section 2. That all Ordinances or parts of Ordinances in conflTC i� eF"rewith be and the same are hereby repealed. Section 3. This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
