AN ORDINANCE LICENSING DRY CLEATMRS, SPOTTERS
AND SELF SERVICE COIN OPERATED DRY CLEANING
ESTABLISHMENTS.
NOW, TIM EFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois:
Section 1. That Chapter 22 of the Municipal Code of
Elk Grove Village be and is hereby amended by adding thereto
the following:
"ARTICLE XVI]TDRY CLEANERS, SPOTTERS AND SELF
SERVICE COIN OPERATED DRY CLEANING
ESTABLISI=ENTS.
22.1. Definitions. A "dry cleaner" or "person en-
gaged in the business of dry cleaning" is hereby defined to
mean any person keeping or using more than two quarts of any
solvent other than water, including, but riot by way of limita-
tion, solvents of the petroleum distillate type, coal tar
distillate type or chlorinated hydrocarbon type, for the pur-
pose of cleaning or renovating wearing apparel, fabrics, tex-
tiles, drapes, curtains, rugs, blankets, furs, leather, or
other material, for profit or reward.
A "spotter" or `person engaged in the business of spottings
Is hereby defined to mean any person keeping or using two quarts
or less of any solvent other than water, including, but not by
way of limitation, solvents of the petroleum distillate type,
coal tar distillate type or chlorinated hydrocarbon type, for
the purpose of cleaning or renovating wearing apparel, fabrics,
textiles, drapes, curtains, rugs, blankets, furs, leather, or
other material, for profit or reward.
22.1 02. License required. It shall be unlawful for any
person to engage in the business of dry cleaning or spotting
without first obtaining a license for each dry cleaning or
spotting establishment to be conducted by such person.
22.jV3. Application. An application for said license
shall be made in conformity with the general requirements of
this code relating to applications for licenses. A separate
application shall be made for eacli drz* cleaning or spotting
establishment engaged in by the applicant wherever located
within the Village.
At the time of filing such application, the applicant
shall also file an affidavit specifying the type of cleaning
solvent to be used, and stating that no cleaning solvent other
than that specified in the affidavit will be employed. If at
any time subsequent to the filing of the application and
affidavit, the applicant desires to change the type of solvent
specified in the affidavit, he may do so only upon the filing
of an amendment to his application and affidavit describing
the proposed change; provided, that compliance is made with all
ordinances relating to the use of such solvent.
Evers such application shall be approved by the building
inspector and the fire chief as to compliance of the premises
named therein with the building provisions and fire regulations of this
code, respectively, before a license shall be issued.
The health department and fire chief shall cause an investigation
to be made of the premises named and described in such application for the
purpose of determining whether the provisions of this code regulating
health, safety and sanitation relating to such establishment have been
complied with.
22.1$04. License fee. The annual license fee for engaging in the
business of dry-cleaning is hereby fixed as follows:
00.00 for each storage tank having a capacity of 550 gallons
or less.
;DA5.00 for each tank having a capacity of more than 550 gallons and
not exceeding 1065 gallons.
An additional fee of 405.00 shall be charged for each 1,000 gallons
capacity or fraction thereof in excess of 1065 gallons.
In no event shall the annual license fee for engaging in the dry
cleaning business be less than J75.00.
The license term for all licenses provided for in this Article
shall be for the period commencing May 1 and ending April 30 of each year.
All applicants for a license shall pay the fee herein provided for,
provided, however, that applicants for a license, provided for herein, for
the period beginning on or after November 1 of any year shall be required
to pay but one-half of the amount provided for hereunder for the unexpired
period of the license term.
If any dry-cleaning plant licensed under this Chapter shall be
abandoned, or if any such dry-cleaning plant shall not be used for a period
of six months or more, the license issued for the operation of such dry-
cleaning plant shall automatically terminate and no new license shall be
issued for the operation of such dry-cleaning plant until and unless the
plant shall be made to comply with all the requirements and provisions
of this code.
The license fee for engaging in the business of spotting is hereby
fixed at 130.00 dollars per year.
22.1$05. Transfer of license. No license granted under the
provisions of this chapter shall be assigned or transferred to any other
person, nor shall any such license authorize any person other than the
licensee named therein to do business or act under such license.
22.1806. Posting of license. Such license shall be posted in
a conspicuous place in the room where the dry cleaning or spotting is done.
22.1907. Certificate of fitness. Before any operation shall
begin under a license for the business of dry cleaning in which flamrpble
liquids having a flash point below one hundred forty (140) degrees F arenheit
(closed cup tester) are used as herein, provided, the licensee shall file
with the fire chief, in writing, the name of the person designated by him
to have charge of the room, the equipment, the flammable liquids to be
used and the handling and using of same during the conduct of such method
of business of dry cleaning, and any such person before being permitted
to exercise any of such functions shall make application in writing to
the fire chief for a "certificate of fitness". Before the issuance of

any such certificate the said fire chief shall examine such applicant
as to his qualifications to fill such position under the conditions
herein prescribed: and no operation or dry cleaning in which such flammable
liquids are used or the handling of such flammable liquids shall be
carried on upon the premises unless there be in charge and authority
upon such premises a person who shall have obtained a "certificate of
fitness" as herein provided.
To receive a certificate of fitness the person must:
(a) Be at least twenty-one years of age;
(b) Be able to understand and speak the English language.
(c) Show by written certification that he has had six months
or more experience in the actual work of dry cleaning
and the handling of flammable liquids having a flash
point below one hundred forty degrees Fahrenheit (closed
cup tester);
(d) Be familiar with the provisions of the law and the
regulations governing dry cleaning, particularly that
part relating to the service to be performed by the
applicant; and
(e) Be familiar with the risks incident to the service to
be performed by him, and capable of taking all necessary
precautions.
22.1108. Building and equipment requirements. Every new building
constructed for the purpose of dry cleaning shall be built and equipped as
required by the building provisions of this code.
Every dry cleaning establishment shall be equipped with an asbestos
blanket of a size not less than six feet by nine feet. Said blanket shall
be placed inside of dry cleaning rooms near the door thereof and in such
position that it shall be accessible for use in case of fire.
22.1909. Location of establishment. No such dry cleaning or
drying establishment in which a flammable solvent having a flash point
below one hundred forty degrees Fahrenheit (closed cup tester) is used shall
be located on any lot or plot of ground where any of the boundaries of such
lot or plot of ground are within one hundred feet of the nearest boundary
of any lot or plot of ground used for a school, church, hospital, or theater.
22.1910. Other use of premises. It shall be unlawful for any
person to conduct or operate the business of dry cleaning in which a
flammable solvent having a flash point below one hundred forty degrees
Fahrenheit (closed cup tester) is used or stored in any building, any
portion of which is used or intended to be used for other than dry cleaning
or drying purposes.
22.1911 . Separation of cleaned and uncleaned articles. Every
person engaged in the business of dry cleaning or spotting shall provide
proper facilities and equipment for the separate handling of cleaned and
soiled articles, and no clean article shall be allowed to come in contact
with any uncleaned or soiled article of any kind at any time.

22.1$12. Emission of vapors. Vapors or odors emanating from
any dry cleaning or spotting establishment shall not be permitted at any
time to become a nuisance to any portion of the premises in which such
establishment is located, nor to any adjoining or nearby premises.
22.1813. Handling of flammables. Tanks for the storage of
any volatile flammable liquids used in connection with dry cleaning
plants shall be in accordance with National Fire Underwriters standards.
SELF-SERVICE COIN CPERATED DRY-CLEANING ESTABLISH;QENTS
22.1814. Compliance. Dry-cleaning establishments commonly
known as self-service coin --operated shall comply with the following
regulations.
22.1515. Attendant. There shall be present in every self-
service coin-operated establishment an attendant during all operational
hours of the establishment. The attendant shall not permit any person
under the age of 15 years to operate any such machine.
22.1516. Certificate of fitness. No person shall act as an
attendant in any such dry-cleaning establishment, unless he shall be the
holder of a current certificate of fitness, issued by the Fire Chief and
the health officer, Before the issuance of any such certificate, the
Fire Chief and the wealth officer shall examine the applicant as to his
qualifications to fill such position. To receive a certificate of fitness
the applicant must.:
(a) Be at least 21 years of age;
(b) Be able to understand and speak the English language;
(c) Be familiar with the provisions of the law and the
regulations governing dry-cleaning, particularly that
relating to the service to be performed by the applicant;
and
(d) Be familiar with the risks incident to the service to
be performed by him, and capable of taking on necessary
precautions.
22.1817. Plans. .".ny person establishing a dry-cleaning
establishment of the coin-operated self-service type shall be required to
submit to the building inspector for his approval a complete set of plans
and specifications of the building in which any such dry-cleaning establish-
ment is to be located and also a complete diagram of the floor plan of each
room to be occupied by such dry-cleaning establishment, correctly showing
the arrangement or setting of all machinery and equipment to be installed
therein. Each such plan shall be explicit and complete.
22.1818. The annual license fee for engaging in a self-service
coin-operated dry-cleaning establishment is hereby fixed as follows.
,)15.00 for each dry-cleaning machine up to and including the first ten
machines and
00.00 for each machine in excess of ten machines maintained upon the
premises.

22.1819. Inspection of establishment. It shall be the duty
of the Fire Chief and health department to inspect each dry cleaning or
spotting establishment at least once every six months.
22.1$20. Penalty. Any person violating any of the provisions
of this Article shall be fined not less than 4'110.00 and not more than two
hundred dollars for each offense. A separate and distinct offense shall
be held to have been committed each day any person continues to violate
any of the provisions hereof.
''ection 2. This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
