HomeMy WebLinkAboutORDINANCE - 265 - 1/10/1963 - REZONE DEVON AND 83ORDINANCE NO. 265 AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE RELATING TO PROPERTY BOUNDED BY DEVON AVENUE ON THE NORTH AND ROUTE 83 ON THE WEST, IiN DU PAGE COUNTY, ILLINOIS WHEREAS, the Board of Appeals of the Village of Elk Grove Village, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal No. 62-7), considered the question of reclassifying the real estate hereinafter described from R-1 (20,000 Square Feet Single Family Dwelling District) to M-2 (Heavy Industrial District); AND, WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, having considered the recommendation of said Zoning Board of Appeals, find and believe that the highest and best use of said real estate is that of M-2 (Heavy Industrial District). NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, and DuPage County, Illinois: Section 1. That an ordinance entitled "An ordinance to regulate and limit the height and bulk of buildings; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open space within and surrounding such buildings; to classify, regulate and restrict the location of trades and industries and the location of buildings designed for specified industrial business, residential and other uses; to divide the entire Village of Elk Grove Village into districts for the purpose of this ordinance; to fix standards to which buildings or structures shall conform; to prohibit uses, buildings or structures incompatible with the character of such districts respectively; and to prevent additions to and alterations or remodeling of existing buildings or structures in such a way as to avoid the restrictions and limitations lawfully imposed hereunder, and to provide penalties for violation hereof," passed and approved July 8, 1957, known as Ordinance No. 20, as amended, be amended by reclassifying the following described real estate from R-1 (20,000 Square Feet Single Family Dwelling District) to M-2 (Heavy Industrial District): The West half of Fractional Northwest quarter of Section 2, Township 40 North, Range 11 East of the Third Principal Meridian, DuPage County, Illinois; ALSO The North half of the Northwest quarter of the Southwest quarter of Section 2, Township 40 North, Range 11 East of the Third Principal Meridian, DuPage County, Illinois; ALSO A part of the East half of fractional West half of Section 2, Township 40 North, Range 11 East of the Third Principal Meridian, described as follows: Commencing at the Northwest corner of said East half of said fractional West half; thence South along the West line of said East half of said fractional West half 38 chains and 162 links, more or less, to the South line of the North half of said. Section; thence East 5 links along said South line of North half of said Section; thence North 38 chains, 16z links, more or less, to the Northwest corner of the Subdivision known as Devon Five Acre Farms; according to the plat thereof recorded June 10, 1947 as Document No. 522698; thence West 15 links, more or less, to the place of beginning (excepting therefrom such part or portion thereof as has heretofore been dedicated to the State of Illinois for Highway purposes by instrument dated July 12, 1937 and recorded July 14, 1937 as Document No. 381700), DuPage County, Illinois. Section 2. That said real estate as reclassified shall be subject to all the limitations and conditions placed upon properties in the M-2 (Heavy Industrial District) as defined in the ordinances aforementioned. -1- Ord. #265 Section 3. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this 10th day of January, 1963.
