AN ORDINANCE AMENDING THE MUNICIPAL CODE OF ELK GROVE VILLAGE BY ADDING THERETO
CHAPTER 22A RELATING TO VILLAGE WATER AND SEWER
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois:
Section 1. That the Municipal Code of Elk Grove Village is hereby amended by
adding thereto the following:
"Chapter 22A. Water and Sewer.
"Article I. General Provisions.
"Section 22A.101. Turning on of water. No water from the Village water supply
shall be turned on for service into any premises by any person except upon the
order of the Superintendent of Public Works of the Village.
"Section 22A.102. Application. Application to have water turned on shall be
made in writing to the Superintendent of Public Works and shall contain an
agreement by the applicant to abide by the ordinances of the Village including
provisions contained in this Chapter and in Section 8.005 of this Code.
"Section 22A.103. Plumbing. No water shall be turned on for service in any
premises in which the plumbing does not comply with the ordinances of the Village,
provided, however, that water may be turned on for construction work in un-
finished buildings subject to the provisions of this Chapter.
"Section 22A.104. Tap -on and inspection fees. No connection to a water or sewer
main shall be made without a permit being issued and 24 hours notice having been
given to the Superintendent of Public Works. All such connections shall be
made and worked on at the expense of the applicant, who shall furnish materials
necessary for such work. All such connections shall be made under the supervision
of the Superintendent of Public Works and no connection shall be covered until the
work has been inspected by him. Application for a connection to Village water or
sewer main shall be made to the Superintendent of Public Works together with a
tender of the proper tap -on and inspection fee in an amount determined by
resolution of the President and Board of Trustees and in accordance with the
provisions of Section 8.005 of this Code, prior to the issuance of any permit.
"Section 22A.105. Re -sale. No water shall be re -sold and distributed by the
recipient thereof from the Village supply to any other premises than that for
which application has been made and the meter installed, except in case of
emergency.
"Section 22A.106. Tampering. It shall be unlawful for any person not authorized
by the Village to tamper with, alter or injure any part of the Village water or
sewer facilities or any meter.
"Section 22A.107. Any person, firm or corporation violating any provision of
this Article I shall be fined not less than $1.00 nor more than $200 for each
offense and a separate offense shall be deemed committed on each day during or
on which a violation occurs or continues.
"Article II. Service Pipes.
"Section 22A.201. Installation. All water and sewer pipes from the mains to
the premises served shall be installed by and at the cost of the owner of the
property to be served on the applicant for the service. Such installation shall
be under the inspection of the building '_nspector.
"Section 22A.202. No water and sewer service shall be installed unless it con-
forms to specifications drawn up by the Village Engineer and approved by the
President and Board of Trustees, a copy of which shall be kept on file in the
office of the Superintendent of Public Works.
"Section 22A.203. Repairs. All repairs for water and sewer service pipes and
plumbing systems of buildings shall be made by and at the expense of the owners
of the premises served. The Village may in case of an emergency, repair any
service pipes and if this is done the cost of such repair work shall be repaid
to the Village by the owner of the premises served.
"Section 22A.204. Excavations. Excavations for installing water and sewer
service pipes or repairing the same shall be made in compliance with the
ordinance provisions relating to making excavations in streets. Provided,
that it shall be unlawful to place any water and sewer service pipe in the
same excavation with or directly under any drain pipe or sewer pipe.
"3ection 22A.205. Shut-off boxes. Shut-off boxes or service boxes shall be
placed on every service pipe, and shall be located between the curb line and
the sidewalk line where this is practicable. Such boxes shall be so located
that they are easily accessible and shall be protected from frost.
'Vection 22A.206. Any person, firm or corporation violating any provision of
this article shall be fined not less than $1.00 nor more than 6200.00 for each
offense, and a separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.
"Article III. Meters.
"Section 22A.301. Meters required. All premises using the Village water
supply must be equipped with an adequate water meter furnished by the Village
or approved by the Village, but paid for by the consumer; provided, that such
water service may be supplied by the Village at a flat rate of charge until
such meter may be installed. Before any premises are occupied a water meter
shall be installed therein as herein required or application made for such
water service at the flat rate of charge until the meter can be installed or
no water shall be furnished such premises.
"Section 22A.302. Installation. Meters shall be installed in a location that
will be easy of access.
"3ection 22A.303. Reading meters. The Superintendent of Public Works shall
read or cause to be read every water meter used in the Village at such times
as are necessary that the bills may be sent out at the proper time.
"Section 22A.304. Testing meters. Any municipal water meter shall be taken
out and tested upon complaint of the consumer, upon the payment of a fee
determined by resolution of the President and Board of Trustees. If upon
test the meter is not within three percent of being accurate, it shall be
repaired or replaced and the fee shall be returned to the consumer.
"Article IV. Water Rates.
"Section 22A.401. All property upon which any building has been or may here-
after be erected, except municipal buildings hereinafter referred to, having
a connection with any mains or pipes which are or hereafter may be constructed
and used in connection with the Village water system, shall pay the following
rates per month:
First 4,000 gallons or less per month - 44.00
Next 4,000 gallons per month - 65¢ per 1,000 gallons
Next 4,000 gallons per month - 45¢ per 1,000 gallons
All in excess of 12,000 gallons per month - 35¢ per 1,000 gallons.
A minimum charge shall be made to each consumer dependent upon the size of
meter required for the installation in accordance with the following schedule:

"Section 22A.402. All school districts, park districts or municipal corporations,
except the Village of Elk Grove Village, served with Village water shall pay
water rates in accordance with the following schedule:
First 4,000 gallons or less per month - 'u2.00
Next 4,000 gallons per month - 371-¢ per 1,000 gallons
Next 4,000 gallons per month - 22 ¢ per 1,000 gallons
All in excess of 12,000 gallons per month - 17¢ per 1,000 gallons.
A minimum charge shall be based upon the size of meter required for each installa-
tion and shall be made in accordance with the following schedule:

"Section 22A.403. Water for building or temporary purposes. All water used
for building purposes or other temporary purposes shall be based upon metered
consumption of the water used at the rate of $1 per 1,000 gallons plus reasonable
charges for employees attendance at hourly rates to be determined by resolution
of the President and Board of Trustees from time to time.
"Section 22A.404. Private fire protection service. The Village will furnish
unmetered water service available to all consumers in the Village to whom
metered water service is furnished for private fire protection solely, said
charge shall be based upon the size of the service pipe and shall be in
addition to other charges rendered for metered service. The rate to be as
follows:

'Article V. Sewer rates.
"Section 22A.501. Sewer rates for property also serviced with Village water.
All property upon which any building has been or may hereafter be erected
having a connection with any Village water and sewer mains or pipes which
presently exist or may hereafter be constructed, shall pay the following sewer
system rates for service based upon the amount of water consumed upon the
premises to which the sewer service is furnished:
First 4,000 gallons or less per month - v1.50
Next 4,000 gallons per month - 15¢ per 1,000 gallons
Next 4,000 gallons per month - 10¢ per 1,000 gallons
All in excess of 12,000 gallons per month - 8¢ per 1,000 gallons.
A minimum charge of w1.50 per month shall be made to each consumer of water
and sewer service for the sanitary sewer service furnished.
113ection 22A.502. Sewer rates for property served only with sewer service.
All property upon which any building has been or may hereafter be erected having
a connection with sewer mains or pipes but not with Village water mains or
pipes shall pay a flat rate of &2.00 per month.
"Article VI. Billing and collection of water and sewer charges.
"Section 22A.601. Bills for water and sewer service shall be dated and sent
out at such times as may be directed by the President and Board of Trustees.

"Section 22A.602. Delayed payment charge. An additional charge amounting to
5 percent of the bill will be added to the bill for water and sewer services if
not paid within 10 days of the due date of the bill, said date to be established
from time to time by resolution of the President and Board of Trustees.
"Section 22A.603. Nonpayment. The water supply may be shut off from any
premises from which the water and/or sewer bill remains unpaid for a period of
10 days after the due date of the bill. When shut off, water shall not be
turned on except upon the payment of a usual fee for turning on the water, which
fee shall be established by the President and Board of Trustees.
"Section 22A.604. Lien. Charges for water shall be lien upon the premises as
provided by statute. Whenever a bill for water or sewer service remains unpaid
60 days after it has been rendered, the Clerk may file with the Recorder of
Cook or DuPage Counties a statement of lien claim. This statement shall contain
the legal description of the premises served, the amount of the unpaid bill, and
a notice that the Village claims a lien for this amount as well as for all charges
for water served subsequent to the period covered by the bill. If the consumer
of water and sewer whose bill is unpaid is not the owner of the premises, and the
Clerk has notice of this, then notice shall be mailed to the owner of the premises,
if his address is known to the Clerk, whenever such bills remain unpaid for a
period of 60 days after it has been rendered. The failure of the Clerk to record
such lien claim or to mail such notice, or the failure of the owner to receive
such notice, shall not affect the right to foreclose the lien for unpaid water
and sewer bills as mentioned in the following section.
113ection 22A.605. Foreclosure of lien. Property subject to a lien for unpaid
water and sewer charges shall be sold for nonpayment of the same, and the
proceeds of such sale shall be applied to pay the charges, after deducting
costs, as is the case in the foreclosure of statutory liens. Such foreclosure
shall be by bill in equity in the name of the Village. The Village attorney
is hereby authorized and directed to institute such proceedings, in the name
of the Village, in any Court having jurisdiction over such matters, against
any property for which water and sewer bills remained unpaid 60 days after
being rendered.
"Section 22A.606. Penalty. Any person, firm or corporation violating any
provision of this article shall be fined not less than $1.00 nor more than
:200.00 for each offense, and a separate offense shall be deemed committed
on each day during or on which a violation occurs or continues."
Section 2. That this ordinance shall be in full force and effect from and
after its passage, approval and publication according to law.
