HomeMy WebLinkAboutORDINANCE - 230 - 5/14/1962 - EXCAVATION PERMITS, ISSUANCE OFORDINANCE NO. 3 AN ORDINANCE AMENDING SECTIONS 11.302, 11.303 and 11.306 OF THE MUNICIPAL CODE OF ELK GROVE VILLAGE, RELATING TO APPLICATION AND ISSUANCE OF EXCAVATION PERMITS AND PROVIDING FOR CASH ESCROWS TO GUARANTEE RESTORATION NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1. That Section 11,302 of the Municipal Code of Elk Grove Village be and is hereby amended to read as follows: "11.302 Applications. Applications for such permits shall be made to the Village Clerk, and shall describe the lo- cation of the intended excavation or tunnel, the size thereof, the purpose therefor, and the person, firm or corporation doing the actual excavating work and the name of the person, firm or corporation for whom or which the work is being done, and shall contain an agreement that the applicant will comply with all or- dinances relating to the work to be done." Section 2. That Section 11.303 of the Municipal Code of Elk Grove Village be and is hereby amended to read as follows: "11.303 Issuance. No such permit shall be issued ex- cept on order of Building Inspector." Section 3. That Section 11.306 of the Municipal Code f Elk Grove Village be and is hereby amended to read as follows: "11.306 Deposit. No such permit shall be issued un- less and until the applicant therefor has deposited with the Clerk a cash deposit in the sum of One hundred ($100) Dollars, if no pavement is involved, and Two hundred ($200) Dollars, if the excavation is in a paved area, to insure the proper restoration of the ground and laying of the pavement, if any. From this de- posit shall be deducted the expense to the Village of relaying the surface of the ground or pavement and of making the refill if this is done by the Village or at its expense, and the balance shall be returned to the applicant *.without interest after the tunnel or excavation is completely refilled and the surface or pavement is restored." Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this 14th day of May, 1962.
